You are right of course, but there is no report this button in these forums that I can see.

It's the little 'warning' sign (exclamation mark in a red triangle) in the bottom left of each post.

    No you are not.

Under the Copyright, Designs and Patents Act 1988 it's illegal to duplicate copyrighted material without the permission of the copyright holder. Unlike the US, this law includes copies made for personal use, such as copying a tape/CD you own so that you can play it in the car, or making burning a CD you that own so that you can transfer it to an mp3 player, or making backup copies.

I'll believe you if you can show a link to the relevant part, I've had a quick look and can't see anything about what we are talking about.

Update, I am willing to agree the laws were changed in 1988 or thereabouts and it is now illegal, that's why we "discuss" so we can all learn. It's a lot better to allow discussion so everyone can learn rather than having threads deleted (as happened on this subject in the recent past) resulting in the fact that no one can learn.

There is it seems an exemption for computer software, which overides any implied warning from the manufacturer which might accompany the software.

Fair enuff, but "little" is right, I've never seen it before, hardly very conspicuous.

This may be partly true, I understand copyright lasts for 50 years but when I asked on imdb they said something like 75 or 100 years so I am unsure of this.

The length of copyright depends on the which country you are talking about, the type of media, when it was made, and whether the copyright is held by a corporation, or an individual.

    nightswimmer,

Presumably then post #12 is referring to an american act?

    I presume so.

In America, you do have the right to make a backup copy (or copy a CD you own to tape for personal use, etc.) under the legal concept of 'Fair Use' . However, things have been made more complicated recently with the introduction of The Digital Millennium Copyright Act (DMCA) in 1998.

This act made it illegal to circumvent any copy protection measures used on CDs/DVDs, etc. So there is now this weird situation where it is legal in the US to make a backup copy, it's just not legal to use any of the methods that you would need to use in order to make such a backup of a copy protected CD, DVD, etc. (If that makes sense.)

    I couldn't agree more.

I have just emailed Random House (copyright holders for Harry Potter) so lets see if that quickens things up a bit.

I also told them they deserve to be ripped off if they don't take companies like Ebay to court over this issue. Why should I bother to point out copyright infringements if the companies who hold the rights are not prepared to fight Ebay on this issue. I mentioned to them Music industry Vs Sharman Networks in Australian courts, where it was held that Sharman networks were responsible for copyright violations on their network by users using their network.

It will be interesting to see if they reply, or take any action. I'm guessing you probably shouldn't hold your breath though. :(

I purchased a DVD game on ebay recently and the next day ebay 'unregistered' the seller.

Turns out the seller got pulled for selling copy DVD's. However he had a feedback of almost 80, all through selling 'back up' copies so I think it took ebay a while to get round to doing anything!!

This didn't really do ebay much good tho - the seller honoured all purchases (including mine) and already had a new user name set up ready to use as soon as this happened.
