    The answer to your question is NO.

    And I did not search specifically for sellers selling counterfeit goods (as some posters here seem to be suggesting), I found it as I was searching for a copy of Harry Potter 5. And because someone recently said here that Ebay now take action on sellers of counterfeit goods and I am yet to be persuaded that this is true, I decided to start this thread. In the hope that the people who previously said Ebay now do take action will

    a) Report it themselves
    b) see that they were right, or,
    c) see that I was right (no action taken by Ebay)

    He is doing nothing wrong as he clearly states you must own the original article, the person buying is actuallly committing fraud if they do NOT own the original article.

    It IS ok by Ebay for people to do this as they cannnot "police" who buys them

    I am sure nothing will come of this as i say the seller is not doing anything wrong but the buyer might be if they do not own them in the first place

    It is illegal to sell copied media - period. It makes no difference if the buyer owns the original works.

    It is Ebays responsibility to remove illegal listings by looking for them themselves and when informed by users of their existance, if they don't then Ebay is complicit in the act of selling counterfeit goods which would be an offence.

    I am still under the impression Ebay do nothing about it, As we can witness in this thread the listings are still there and I have had no response from Ebay. Some users in this board claimed otherwise recently so I decide to run this test case.

    If eBay gave a toss about illegal goods, they'd have a "report this" button on every listing, just like on every posting to this forum. Instead, theyying to make you jump through 15 hoops, trying to fob you off each time. Or have I missed something?

    Your absolutely right.... why haven't Ebay thought of that...or are they too busy taking our money......

    When we approached the seller, they said it was perfectly legal as the copyright had run out years ago?? They refunded £3.50 of the money and we have left it at that really. We werent happy about buying copies

    This may be partly true, I understand copyright lasts for 50 years but when I asked on imdb they said something like 75 or 100 years so I am unsure of this.

    The film - if the copyright has expired - still cannot be copied from a commercial dvd or TV broadcast because as I understand it (and could be wrong) you will be copying someone elses work in cleaning up the film and putting it into a commercially released format. If you can get hold of a print which is over 50 years old then you will presumably have no problem if you can clean it up and convert it to dvd yourself.

    So the seller was still probably acting against someones copyright.

    You are right of course, but there is no report this button in these forums that I can see. You may be thinking of other forums like imdb

    Under the Copyright, Designs and Patents Act 1988 it's illegal to duplicate copyrighted material without the permission of the copyright holder. Unlike the US, this law includes copies made for personal use, such as copying a tape/CD you own so that you can play it in the car, or making burning a CD you that own so that you can transfer it to an mp3 player, or making backup copies.

    Also, under the EU's Copyright and Related Rights Regulations 2003, which came into force in the UK at the end of October 2003, it is illegale to make, use or publish any software, hardware, or even give instructions, that would circumvent any copright measures put in place in computer games or on a CD/DVD.
