Sale Agreement

Hi

Could anyone tell me that if a sale agreement is not signed does this make it invalid ?

I purchased a puppy taking breeders to court ?

  • Are you saying you purchased a puppy in full and didnt take it home with you? Normally if a puppy is not ready to leave the litter yet, you should only pay a deposit to secure the puppy you want, which you will lose if you then dont go back to collect when its ready to leave. What kind of breeder did you purchase from?
  • The sale of puppies is covered by the Markets Acts rather than Sale of Goods Acts. This is a much less robust set of legislation in that it does have tacit "gentlemans agreement" built within. What this essentially means is that you as a purchaser have virtually no rights at all, but on the other hand neither does the seller. The law of contracts does not come into it.

    I disagree, any agreement for business purposes could be looked upon by the court as a contract.

    Although the sale of puppies is covered by the Markets Act there still may be a valid contract between you and the breeder provided there was consideration given on both sides (ie you the money and the breeder the dog) but it could be a case of caveat emptor (buyer beware).

    Even if there was no written contract there still could be a verbal contract and the court could imply terms into that contract such as the dog you were supplied with should be a healthy dog, disease and defect free etc.

    If you really want to take the breeder to court for whatever reason then I think you are probably best consulting a solicitor.

    Aye think we need this expaned on (more for interest than anything) you aren't giving much info.

    My mother bought a new puppy recently and we all felt it wasn't quite right (back legs) and felt it should go back, but needless to say she wouldn't hear of it. We then suggested she spoke to the breeder but she is a bit secretive about whether she got any money back, dog will preobably cost a fortune now in vets bills.
  • I contacted Consumer Direct who advised me I could claim under sales of goods act because a dog is classed as goods in law..

    My claim has been accepted and evidence been submitted..

    Basically within 2 weeks of buying my puppy she fell very ill and has liver and digestive problems as well as other medical ailments,also breeder concealed on puppy's medical card she had a grade 1 heart murmur also pedigree cert is fake.Also discovered she came from a puppy farm. With regard to sale agreement I was asking because basically I want to cover all angles and if seller did not date agreement would that make it invalid..

    I still have my puppy and would not part with her for anything she is part of our family.

    i am so sorry your pup is unwell..i hope the 'breeder' gets the book thrown at them.

    if its any consulation my 14yo cat has a heart murmur...and he has managed to reach aripe old age.

    you are so lovely for keeping hold of the puppy...more than ever she needs you now as she wouldn't stand a chance getting rehomed :T
  • Ah thanks for your supportive words..We would not be without her...

    Puppy Farms and those that deal and buy from them have to stop what they are doing..sadly not enough water tight legislation in place to prevent this evil trade...
  • i couldnt agree more, i think my bishon is from a puppy farm , he is 18 months now and healthy , and i hope he stays healthy.

    How could you not tell she came from a puppy farm when you picked her up? I'm not sure you will get anywhere with this claim to be honest but goodluck anyway.

    Do you think puppy farms have signs on the doors?

    They come in all guises and one of the most popular way of selling on puppy farmed pups is looking for all the world like a normal family home.

    And for those that dont know - 99% of pups sold in shops are puppy farmed

    This is why we advocate only buying a puppy via the breed club, not the small ads, not web sites, not the KC - BREED CLUBS or RESCUE

    Good luck with your claim. more and more people are having success through the courts and at least these evil people will be named and shamed
