No Refund From Seller As Promised

I am currently a very unhappy ebayer :(

I purchased a brand new 3 wheeler pushchair for my daughter about a 3 and a half weeks ago from an ebayer with a 99.1% feeback rating. I purchased it on a Saturday and it had arrived at 9.30am the following Tuesday, brilliant so far. Then I put it all together, again I was very happy as it was just what I wanted. I then attempted to pump up the tyres and this is where the problem has started. One of the tyres kept letting out air when I was trying to pump it up. Under closer examination I found that there was a large split around the base of the valve. I emailed the seller and explained what had happened and I was advised to take it to a local bike shop and get them to repair it, send her the receipt and I would be reimbursed.

Well, I went into my local bike shop and was told that I'd have to have the inner tube replaced as they were unable to repair it with the split being on the valve. So, I had that replaced, obtained a receipt for £9 and then emailed the seller when I got home to let her know what had happened. Still no problem, I was told to send the old inner tube back with the receipt and I would be issued with a refund as soon as she had received it.

Well that was 3 weeks ago now and I have to say that I am getting extremely cross :mad: I emailed a week after I'd sent it to ask if it had been received and when I would get my refund. She told me that she hadn't received it and it was probably lost somewhere in the christmas post, she said that she would advise me when it had arrived and issue the refund as promised. I find it abit strange as I've ordered other things through ebay and the last time was Friday of last week and strangely that arrived on Tuesday! So I'm starting to think that she's trying to pull the wool over my eyes and just hope that I'll eventually forget. I emailed her again on Tuesday of this week asking if she's received it and when I'll get my refund, also explaining about the other goods I've received with no problem and as yet she hasn't responded. What do I do now? I'm not the sort of person that likes to hassle people and like to give them the benefit of the doubt but I think the christmas post thing just an excuse.

Sorry that this post is abit long winded! Any advice would be greatly received.

  • Some items are taking forever to be delivered by RM at the moment. I ordered some perfume from an online retailer on 23rd Nov and it arrived two days ago, that was first class post. I'd already rung up the company and complained and they'd sent me a replacement by Special Delivery which arrived 3 days before it. I haven't told them as I'm happy to let RM foot the bill for the original perfume simply for having the cheek to take 4 weeks to deliver a first class item!

    Also, I sent an item 1st class recorded and it arrived 15 working days later, which is the last day before you can claim for non-delivery.

    I know its 'that' time of year but RM need to get their act together - its not as if Christmas is an unexpected event!

    With regard to your problem, if you didn't send the item either recorded or special delivery then you'll never be able to prove she's got it. Did you at least get a Certificate of Posting so that you put in a claim with Royal Mail?

    Yes I did obtain a Certificate of Posting, so that's something I suppose! I know that chrismas can cause havoc with the post but as I've already said, I just find it hard to believe when I've had no problems receiving things!

  • Yes, but Royal Mail don't distinguish one item from another. I think you've either been unlucky or you have a dodgy seller who has actually received it but who isn't willing to pay up. Either way, you're going to have to claim through RM and the COP will make that a lot easier so well done!

    if you paid by paypal and the seller is trying to get you out of the period you can begin a chargeback is always a possibility.

  • Yeah you can do a goods not described BUT sometimes they ask for evidence of the goods which you know longer have if you posted back to the seller so I don't think this would be ideal yet.

  • Log into your PayPal account, click Resolution Centre and 'File A Claim'. You can request a refund of just your costs involved in having the repair carried out and you already have proof (receipt) that this was done so it should go in your favour. Probably worth a try but file ASAP! If you have posted the original receipt (silly) then ask the shop for a copy.

    Yeah, have posted the receipt! But will call into the shop and ask for a copy.

    thanks"


    I don't think so! Do you??? If I send that to her as well then I won't have a leg to stand on, think I'll trace it myself. Sorry to be a pain but is it easy to trace a missing packet? Never had to do it before!

    You should be sending copies of receipts, proof of posting etc
  • For normal first or second class standard there is no way of tracking online, the only ways to track are with RECORDED or SPECIAL Delivery.
