  • I wouldnt worry about it. If you can show you have fully co-operated then that should be sufficient. That said you'll want to know when you've been discharged so make sure that when you're last payment is made that you get onto them pronto to ensure you're discharged promptly and secondly that they'll send the discharge letter to the right address.

    Hello All

I'm over two years into a PTD.

My circumstances have changed on a number of occassions over this period of time eg change in salary and change of address. Each time there's been a change in circumstances, I have advised my IP of this and they've got me to fill in a Status Report form. Notwithstanding these changes in circumstances, I have also filled in Status Reports on a six-monthly basis.

I last received a Status Report form in late Summer 2008. So, going by six-monthly cycles I should've received one in the early part of 2009. I still haven't received one. Also, since then I have moved address and should've received a Status Report form to fill in - nothing has appeared.

I alerted my IP to my change in address via email and this was acknowledged with a reply, but no Status report form.

I sent a further email to advise that I hadn't received a Status Report for a significant length time but this has never been acknowledged.

I am just worried that because there would be no Status Reports forms on my file for the past while that it could be construed that I am not adhering fully to the terms and conditions of the Trust Deed.

Could someone give any advice on what I should do? Has anyone experienced something similar?

  • Firstly, when you were discharged the IP should have given you a list of the debts included and the amounts paid to each. Even if SLC arent shown on this - dont worry they will be included but may not have submitted the necessary info to the IP. If you notice on your salary slip that there's a SLC deduction give them a call and confirm you signed a PTD and provide copies of the IPs documents. If you want you could be more proactive and phone them to check that they have written it off.

    Good luck:T

    Hiya,

I was released from my protected trust deed in January 2009. I was told this includes my student loans as it was taken out in April2005. My wages are about to reach over £15k and I'm paranoid that they will take a student loan payment. Anyone know of anyway to check this?

Any advice would be much appreciated!

    Thanks.

Yeah - when it comes to discharge, I'm quite worried that this slack admin may mean a delay in my discharge.

Thing is, for the first 18 months or so, they were totally on the ball - helpful and prompt in their reponses and also sending Status Reports bang on time. Strange...
  • These IPs have administrators that work these cases for them. It may simply be the case that the previous amdinistrator has left and handed over to someone else or - it has happened - no-one else and the case will stagnate until someone else is recruited. Like most things in life, if you shout loudest you're more likely to get noticed....

  • Hi all,

i have been lurking about here for the past few months as i have been advised to become sequested and my husband has signed a trusted deed through new tomorrow/invocas.

has anyone had any dealings with them?

i have found that they dont give you the same info twice.

our background is that my OH has signed a trusted deed with them(not yet protected) for his debts including a loan with NR(together mtg) but as he was the only earner(i gave up my job to look after our 3 children and cant afford to go back to work it would be like paying a 2nd mtg)there is no funds left in the pot to pay for my 2 credit cards that my OH was paying(and using)....he is paying back 880 per mnth.

anyway they had advised us that my Oh will have to pay £500 to release the IP's intrest in out property that we reckon has around 65k neq equity just now but they have not as yet arranged a valuation for this and from reading other theads they should have done this first:mad:

sorry just a big bad rant there but they never advise you of the same info twice and just annoyed at them.

but if anyone has had any dealings with them i would like advice on how to deal with this

    thanxs
  • hi all ...

georgeUK pointed me to this thread and could any one comment on my questions please ...

i think i may be going down the road of a trust deed and have a question or two , i believe a trust deed last for three years . but what will happen after the three years ? can the creditors send in bailiffs in after the three years to try and take goods ? and what if some of the creditors don't accept what i can afford ? were do i stand then ?

    regards

If all the creditors dont agree then you basically become insolvent & can file for bankrupcy.I think this has to be agreed by two thirds of your ceditors so PTD can go forward.
At end of three years creditors have no further claim & they cant take action once PTD is set up.
    HTH a wee bit.
