I was mis sold a phone by Orange, the salesman who rang me to offer an upgrade told me that the camera was good and it was ideal for my contract. The phone does not have a good camera and Orange will not change my phone as I am 8 hours over the 7 working days rule, the supervisor is starting work at 11.45am so when does a working day start? I have been told there is nothing I can do and I am stuck with this awful phone for 18 months. can't even flog it on as the insurance is tied to that phone. What can I do?

cancel the insurance, sell the phone, buy a PAYG mobile and chuck the SIM use the contract SIM0

but they say they will take me to court if I cancel the contract.0

To be fair, saying that the phone has "a good camera" is subjective. What is good to one person isn't necessarily good to another so as much as I hate to say it, sounds like you've made your bed and now you'll have to lie in it.
If it was me, I would complain like hell to them but don't know if you'll get anywhere. At the end of the day its your own fault (don't mean that in a nasty way) because you've had 7 days in which you could have sent the phone back, you're just too late.
BTW, what phone is it and why does having a good camera matter so much to you?!? To me, the contract is more important than the phone features. I hardly ever use the camera!

The camera matters to me as my parents live abroad and I send them pics of the grandkids. I didn't ask to cancel my contract, I even offered to pay for a handset.0

He didn't say cancel the contract, he said cancel the insurance which you should be able to do at any time without penalty. Once you have done that, you can sell the phone and buy a pay as you go with decent camera and use your contract sim in it!

no sadly he told me the insurance runs along with the contract, he didn't tell me that when I upgraded.
Found this on oftel website though
Ending a contract
You cannot return your phone or cancel the contract, just because you have changed your mind or found a cheaper deal, unless your contract allows you to do this. Check to see if your contract gives you a right to cancel. If it does, the mobile phone company may charge you to do this – details should be in your contract. However, there may be other circumstances in which you can cancel your contract free of charge: for example, if you have paid by credit, signed the contract in your own home, or ordered the service by post, phone or over the internet.0 -
That would be the distance selling regulations I think. This allows up to seven days. Now, are we talking 7 days from receipt of the phone?

7 working days on receipt of the phone, but the sim took 10 hours to register!0

Surely that is against some rules. Did it say in your contract that you MUST have the insurance for the 12 months?!?!

I had insurance on my old handset but was not asked if I wanted to carry the insurance over to the new phone so it came as a bit of a shock that I was also tied to that for 18 months.0
