Goods bought online discontinued but company not given refund

Hi,

I bought a wardrobe from MFI over a month ago expecting delivery yesterday. They attempted deliver half of it and told me the other half discontinued! They made no attempt contact me to explain and offer me a refund so have kept that money for over a month. I asked for a refund and was told I have to wait another 48 hours. Is this legal? Is there anything to protect consummers from this?

  • Not much chance getting money back with mfi have a similar problem and still awaiting refund from 20th september they went into administration 1st oct hopefully you paid via credit card and try to reclaim money back, I stupidly paid by cash. They are currently open being taken over by their management just trying to obtain funds to pay their creditors. I have been to trading standards and everything.

    My MIL is meant to be buying a kitchen from them I told here not to bother they have a terrible reputation and if I did pay I pay by credit card
  • Same problem here, bought 2 wardrobes, 2 chest of drawers on the 6th of Oct, got a delivery date of Nov 11th, at least the driver turned up, but with only 3 boxes (i should have had 11). Was then given a revised delivery date of Dec 6th, i then cancelled and was told my refund would be given back within 5 days (debit card). Load of rubbish, i actually went into the store to complain and was told i would have to wait 28 days for a refund. This will take me to Dec 9th, my question is can i make a claim at the small claims court after the 28 day period?

    In view of their trading position, no-one should really buy anything from them using cash/debit cards etc - if you really must buy from them, then use a credit card, and make sure you spend over £100. (And if they go to the wall, what will you do about any complaints/warranty claims etc)

    My MIL bought form them last week 8K for a kitchen as much as I told her not to buy from MFI, she did pay by cc though after my advice. Already they gone back on there word, kitchen was to be installed before Xmas now its after

    I wouldnt touch that company with a bargepole they always had a bad reputation of deliveries
  • I paid for the goods before they went into administration, also i'll never use a debit card in these places ever again.

    Never been one for credit but will be getting a cc asap.

    Do you have any ts + cs regarding refunds?

    What reason have they given for changing the 5 days (which is reasonable) to 28?

    Before embarking on the scc route, be as sure as you can that they will be in a position to pay up if you win. (You have to pay fees for a small claim, and these are refunded by the defendant if you win. If the defendant cannot pay, then you lose your costs as well as the money owed)

    I thought MFI avoided administration. Also I doubt they went into admin on 1st oct as I took them to the small claims court over my kitchen that they screwed up and they settled in October which they wouldn't have done if they were in Admin.

    Personally OP - if you don't get your money try you credit card company if you paid by that otherwise try SCC.
