parking in hackney
i was proud to get my daughter off this one. visiting her sister in hackney she used a paid for scratch off parking voucher. she scratched off the relavent times, dates etc but missed the am/pm section. (easily done ). she got a ticket all be it that all times were obviously am or pm because it was free for the other same time. ie they used the 12 hour clock so 11 o'lock am is paid for and 11 o'clock pm is free. luckily she arrived at 12 o'clock midday and after consulting with greenwich found out that this is 12 noon and not am or pm. got a snotty letter back from council but they had to waive the ticket. yea, i felt good!0 -
On 7th October I parked at B & Q in Stockport. Due to their mistakes I overstayed the allowed time after new invoices were issued and my van loaded. A car park management firm issued a charge of £80 plus their admin. fee of £30 on an official looking notice. I complained to them, refused to pay and sent a copy of my complaint to B & Q. B & Q telephoned today to say that the charge has been dropped. I have invoiced Parking Eye the amount of £120 for my admin. charges; £30 for four letters. I don't think they will pay but I will keep sending the invoice until they either reply and apologise and will follow up with a threat to issue a summons in the County Court, using the small claims procedure. Just an update - I got the cheque from Newline (later than the 14 days they were allowed to pay, of course) and have paid it into the bank. I haven't heard anything from the bank so presumably it cleared. I was actually getting quite excited at the prospect of involving bailiffs as the days ticked by and the payment became overdue but I guess I should be thankful they paid rather than disappointed I couldn't take the next step.

I'm so glad you won against them! My Mum also had to go to court against these complete cowboys after she came to visit me in London and got charged over £550!!
I was living in a privately rented flat and, unbeknown to us, the Landlord had made the car park permit only. Our agent hadn't made us aware of that when we moved in or given us the permits. We looked out of the window to see my Mum's car in the process of being hitched to a tow truck!! In the end she felt forced to pay just to stop them towing her car. They even charged her a "tow away fee" (which was listed as a "pound release fee") as a final kick in the teeth!
She took them to court over the pound release fee as the car never left the car park and won, but they made the process as difficult as possible and then sent the cheque without a stamp on it - how pathetic can you get? :rotfl:
I don't know if we could have appealed against the whole amount but she felt she was more likely to win by just going after the one clearly unreasonable charge - it was still really stressful though.
Needless to say, I have since moved0 -
Of course you could have got the whole amount back! It wasn't an 'appeal', you were suing them and you could have claimed the whole amount plus interest at 8% and nominal out of pocket expenses.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

exactly the same problem with southwark. it was my car, ive parked and payed legally and after few days got a ticket thru the post requesting payemnt for illegally parking in permit holders bay. the enforcement officer even had the gutt to take picyures of my vehicle and a permit only bay sign (god knows were he got that).
ive appealled and now its going to the adjudicator, luckly for me the photo which the warden took also had some pavement markings by this i filed the exact spot and the signs which said pay and display,0 -

As I had made no error in the first place and as they had acted illegally, I decided to invoice them for my time.
I worked out from my weekly salary what my hourly rate would be and added up all the time it took to write, make calls etc. It came to just under £200. I sent an invoice to Southwark Council Parking Shop, which they ignored. I gave them 28 days to pay and sent a further invoice after that giving them 7 days to pay. When they didn't, I started a Money Claim On Line - costs about £30.
They didn't fight the writ and so I was awarded payment (almost by default). I got a cheque from Southwark Council for costs and legal costs totalling £220!!! I claimed under "reclaiming costs".
Go for it!
would you kind enough to guide me to send and invoice for my trouble since nov 2009. the appeal has gone to the adjudicator and ive filmed the road where the vehicle was parked and the clear signpost that says pay and display.
shall i send the invoice to the one stop shop of southwark??? is there a standard invoice i can use??? is money cliam online good?? who do i address the cliam to?

Having refused to pay 2 private parking tickets because I was not the driver (and because the fines were ridiculous),I followed the procedure Martin suggested and the company have now given up.
Like others I judged that appeals would be futile even though tickets were purchased in both cases
However,if you are going to take this course I suggest you think if the car park concerned is essential to you. I have been banned from using the car park, and although this doesn't bother me personally, it could be a problem to others. I'm not sure how they could enforce the ban but am sure they're entitled to do so and don't intend to test it.0 -
How can they ban you ? Can I ask where this car park is, and what retail units are there ? Also how can they enforce this, if you go in a different vehicle what will they do? If someone else drives your car what happens then ? What happens if you sell the car ?
My thinking is that they need a court order to ban you, somebody will post with more knowledge than myself soon.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
Don't know the car park situation cos I wasn't driving but its a Euro car park in Manchester. Your guess is as good as mine as to how they could enforce the ban but like any seller I'm sure they're entitled to refuse to serve you.0
