I am looking for some advice about having my car clamped by PCN-UK LTD. Myself and my partner were visiting Halo Nightclub in Warrington on 1/4/2010. We returned to our car approx 2hrs later to find it had been clamped by the above organisation. We where told to pay a £120.00 release fee to avoid being towed away, we felt very intimidated by the three male staff. We phoned the police to see if the clamping was legal we were told "If the company has signs up it was legal" we did not see any signs and the carpark was not lit and there were no designated car parking spaces. We paid the fine, and this morning searched the website to complain and were told to put in all of our personal details on the form (which I am wary of doing, after some research has revealed this firm seems a bit dodgy).
Any advice as to what to do next would be greatly appreciated,
Thanks.
2nd, unfortunately the BiB don't want to know even if its an iron clad case against the clampers.
Get pics of all the signs, day and night,
Photo/scan all the paperwork you were given to see if they have broken the rules here, they often do, especially the sia ones.
host on tinypic and copy the url they give you and paste it on here leaving off the http:// bit.
Hopefully someone will be on hand to help soon but bear in mind its a long weekend.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

We thought that PCN-UK had closed down, to be replaced by Vibe Leisure, so why are they still using PCN-UK's paperwork? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
That would nullify the clamp, wouldn't it? I could not just go around issuing invoices from say British Gas, apart from the fact they might get a bit tetchy it would likely be fraud. Interesting to see what the signs say for more ammunition. As long as the poster sues the landowner it should be ok but who should he sue as the clamper?I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

It was Bank Holiday Monday and i parked my car on a single line in a restricted street during prescribed hours and it was observed from 15.02 to 15.02.
I was given a ticket by the LB Barnet.

I was clamped by a private firm in London (on the residential estate where I live) and felt it was unfair. I appealed to them but (needless to say) they rejected it.
I strongly believed I was in the right, so I followed the guidance on this site and decided to take them to court to reclaim the fees. It was a bit nervewracking when they said they would defend the claim and rejected mediation. They had sent a huge bundle of papers to the court, whereas mine was slim in comparison (but I did include photos and all I felt was relevant).
I am SOOOOO pleased to say that today I was successful in the county court :j and have been awarded a full refund plus costs.
Although there were times when I wished I hadn't started down the court route, I'm pleased that I did because I refuse to act as a cash machine for anyone and everyone (it seems at times!) out to make a quick buck.
Keep up the good work here!!I dare say I might have given up if I'd hadn't been encouraged by everything I read on this site.

peter_the_piper wrote: »Can you say who you won the case against please, I do hope its not just the clampers but also the landowner/lessee.
Ideally, I would have liked to add the landowner's name to the claim. However, as the landowner (a housing association) is still my landlord , I felt it would not be in my longer term interests to do so.
But I intend to send a full report of the successful appeal to them. And I'm sure the clampers will too, since they seemed to hold the landowner responsible for not letting me know the parking scheme was in force. Whatever their reasoning, they can sort that out between themselves.0 -
Good luck with getting your money back from the clampers - but don't be surprised if the court bailiffs report back that there were no assets to sieze, and the clamping firm goes into liquidation, only to re-emerge as Newline Securities (2010) Ltd.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
They will have assets, the problem will be in identifying those that are seizable. It may be worth spending a few pounds getting their company report(s).
Bank accounts can be attacked.
Check to see if they have a mortgage or.loan taken out on the company books.
And what assets they have listed.0
