Strange letter from a Debt collection agency! re:SKY

Did you say you have a subscription in your name now or no SKY at all? Do you still have the box? If so, tell them you want it collecting by them or you will charge them storage fees

I thought this was only for the first year. I have not had a landline for 2 years now with no problems with sky.

It is only for the first year! Karma67 just needs to speak to the right person at SKY to convince them all the correct forms were signed and returned and that the box was connected to the phone line,
i.e. Sky should be able to confirm this by looking back at the viewing history for the time involved - their should be records of any box office movies/events and the box rings sky with the veiwing history.
It would be up to SKY to prove in court that the forms were not signed and that the box was not connected to a phone line for the first 12 months. I would be inclined to write to SKY threatening legal action for wrongful harrasment and also threaten to cancel the current subscription.

spoken more indepth about this with my hubby, he was a Sky customer for a few years b4 this and the digital box was an 'upgrade' offer they gave him, he said he returned all agreements when he joined with them originally and had full viewing rights with the digital box aswell, and like i said earlier the engineer took the old box and dish away when i became the customer with them....
I will phone in the morning as adivesed and hopefully get someone to see some sense!!0 -
Lowell Portfolio are well known parasites (sorry, debt buyers) and are probably trying it on. Forget Sky, send the following letter to Lowell by Recorded Delivery and enclose a £1 postal order in payment of the statutory fee.I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

One question though...would this letter work even tho Sky themselves are saying that hubby owes £300...and that they did not get credit agreements back from him...even though he did send them?0 -
Just got off the phone to sky...spoke to someone who first language was English which was as a relief!
I have been adviced to email the correspondence dept with the facts I told him and they will look into it...He saying that the charge is for the contract not being signed that account never being activated????? Very strange indeed!0
