Can madasafish charge for leaving them + MAC for Virgin?

Hi all,

Just wanted to ask, can i migrate from Madasafish to Virgin Media broadband, sicne i'm going from conventional broadband to cable fibre optic?

Also madasafish charge £40 for cancelling your account and not migrating, which i think is extortionate, can they do this?

    MAC code,s are not applicable to services delivered by cable.

    Are you cancelling within your minimum contract period?

    If you are, this would be a deferred activation/setup fee or if you took advantage of a deal in your second year, then this covers it to.

    If not, ISPs have to pay to completely remove broadband from your line (to encourage MAC use) and thus pass this onto the customer.

    The £40 is what we charge for activation of a phone line and if you cancel this within 12 months of the line being activated the fee is payable. If you keep the service past the 12 month mark you'll be able to cancel without being charged this.

    If you let me know your username I can have a look and let you know how much longer that would be if you like?

    I'm past my initial 12 month contract at this stage, its a misunderstanding i've made also. I don't pay £40, i am actually going to pay £20 for 'ceasing activation'. My username is [EMAIL="abbas5001@globalnet.co.uk"]abbas5001@globalnet.co.uk[/EMAIL].

    They brought this cease charge in recently.

    You had a month to either accept it or get out of the contract scot free (no termination charges to pay at all).

    Is it a month since they notified you?

    It was a month yesterday. If the cancellation was requested before then you shouldn't be charged this.

    Abbas, I've had a look at the account and as the broadband was activated in December last year the £40 deferred activation charge stands I'm afraid. However you don't have to pay the £20 cancellation charge that's mentioned in the last ticket update, as the cancellation was requested before yesterday.

    Abbas, this advice is wrong. The maaf ts + cs are quite clear - if you cancel as a result of the introduction of the charge, then you do not have to pay any early termination fee.

    The relevant condition is 10.8:
    10.6 You may terminate this Agreement within the first 12 months after the Commencement Date if you agree to pay us all the costs that we have incurred in setting up your Broadband Service. This will include an installation fee of £40.96. You must also pay the cessation charge detailed in 10.7, and the full retail price for any free or subsidised hardware that you ordered from us.
    10.7 If you terminate this Agreement at any time, and choose not to transfer your Broadband Service using a MAC code, you will be required to pay a cessation (cancellation) fee of £20.00 to remove the Broadband Service from your telephone line. This charge is applied to us by BT.
    10.8 If we have made a change which is to your material detriment, you will not have to pay the charges set out in paragraph 10.6 above if you decide to end your Agreement early. However, once we have told you about such a change, you must let us know that you want to end the Agreement within thirty days.

    That's correct - however the cancellation request in this case was received before the email notification of the ts and cs changes was sent out.

    The poster stated that he had completed his minimum period, so why would maaf still want him to recompense them for activating his line?

    The £20 cessation fee only came into effect yesterday, so if the notice was given more than a month ago, why would maaf be trying to get that once their attempt at the £40 was knocked back?
