    Hello,

I’ve been a newsletter subscriber/lurker for a while, but decided to take some action recently.

Using the template letters on the site I sent the first one off in mid December. I received a reply back from the company involved recently. I’m looking for some other opinions on what to do.

I complained because I took out two personal loans, within the last 5 years, and I was told that the PPI was essential to get the credit, and wasn’t advised that I could have gone to another company for PPI.

The company involved want me to complete a questionnaire for them and return it within 14 days.

They’re asking for the following information for the period when I took out the policies:

    - My/my partner’s occupation
    - Who my employer was
    - Marital status
    - Number of dependants
    - My approximate earnings
    - Any other policies, e.g. bank accounts, stocks/shares, etc.
    - Whether I cancelled/surrendered another policy to take out theirs
    - Purpose of my interview when I took out the policy
    - What discussions I had about the insurance provision
    - Reasons for taking out the policy
    - Whether I told the adviser about any concerns I had about the policy
    - When I spoke to their representative whether (1) they gave me the name of someone else, who then arranged the policy. (2) Provided me with an application form for the policy. Or (3) Other - asking for details.
    - If I’d not taken the policy out, what would I have done
    - My reasons for taking out the policy

I’m then asked to sign a declaration confirming that all the information provided is accurate, truthful, etc.

    Their letter also states:

If you have any paperwork relating to the sale/purchase of your policy(ies) or any other documentation which may be relevant, please enclose copies when returning this questionnaire. It may help us with the investigation of your complaint.”

To me it seems that the information they’re asking for is irrelevant to my complaint, since they should have all of the paperwork / telephone recordings and be able to base their decision on the information they should still hold about me/my policies.

I should add that both loans are no longer running. The 2nd was paid off in full in early 2007.

Do you think I am being too cautious/suspicious and I should complete the questionnaire? Is it normal practice to have these questionnaires sent out?

Also, I’ve left out the company’s name at the moment, but if you need to know this then let me know.

    Hi All,

thought i'd jump on the bandwagon and have a go at this PPI reclaim lark (nothing ventured, nothing gained).
I've just had my first knock back from GE Capital for an Evans storecard which i'm also looking to cancel (haven't used it in an age!).

The points they detailed for refusing all sound valid so i just wanted to check how i would i know if they are just spinning me a line. Basically, should i fish or cut bait?

    1) I changed my name a couple of years ago (divorce woop woop!) so they won't touch anything til i've officially changed with them.

    2) They say the FSA fine only relates to PPIs purchased after 14/01/2005 (i've had the card since 1998) - i don't think that has anything to do with it!

    3) Because i signed a box on the form that said 'Account Cover (only sign this box if you require Account Cover) - the form was completed in the shop and i signed where i was told to, but how do i prove it?

hope you more experienced MSEs can advise me :)

    Thanks,
    Ani

Hi this sound like an advised non-advised sale:eek:. Anyway it may have been that the box was pre ticked and you had to opt out the insurance. Do you have a copy of the original agreement?

Also got my SAR request today from EGG no telephone recordings though:mad:

Its the worst SAR I have ever seen. It's totally crap:eek:

Called them today after waiting in a cue for 30mins:mad: to request telephone recordings on CD told them wish to have them in next 7 days as have already waited over 40days for other info and have reported them to the ICO.
My first SAR from Co-op was just a piece of paper with bank charges on.. nothing else. I then had to wait again while they sorted my loan papers out. They said they did not know what I wanted in the SAR:confused: . I told them everything it said in the letter...

I do not think you are being at all suspicious. Be very careful. They are trying to see if it was an advised or non-advised sale etc. It is getting more normal for the questionnaire to be sent out. If you do not want to answer the form per se, write it out in your own words or if you feel you have covered it in your original letter refer them back to that. Ask them for copies of the agreement etc. Did you send £10.00 off and ask them for a SAR?

Also make sure that your signature is slightly different that usual as some companies have been scanning signatures onto agreements etc. So please be careful.

And got another call today from 3rd party still not even acknowledging that I have cancelled their help. OMG what does it take with these companies.

Then they called back to say I don't need to do anything thats why I pay them a fee. NO THANKS
They won't take no for an answer then...just like the sellers of the PPI.
