HI ALL,
I requested from my bank a copy of loan documentation of all my loans old and current last Nov.24. Today, I received a letter from them saying....
Dear ___,
For the data protection act to apply information which is not stored electronically needs to be held in a structured format which is easily accessible. an example of this would be if information was filed in alphabetical order, referring to the name of the customer and then the file itself was broken down into different topics. information held in such a structured format is known as a Relevant Filing System.
Part of your SAR, the consumer Credit agreement would not generally be held by the bank in a relevant filing system and as such would fall out with scope of the act- this would mean that you would not be entitled to it under the data protection act.

What is my next move? They are trying to block my claims even if I haven't started my claims yet. I rang them and they said they can't locate any copy of loan documentations in my bank.

Natalie6999 This seems to be a standard response to your letter according to Martins web site. I would write them another letter and give them 14 days to reply. Also get on the phone to the ombudsman and try to get a case number from them and threaten Tesco with this. On a lighter note I have just had a phone call from some woman wanting to know my opinion of the banks. I said I would try to answer her questions without swearing. The banks did not come off very well. Chin up girl, we ain't giving up yet0

I just check with the info commissioners office and they said the bank is partly right beause it falls under the Credit consumer act. they can't make the bank produce any copy under the data protection act. The request should be under the credit consumer act.
I rang the the office of the fair trading just now and they said if I want copies of documentation requested use the credit consumer act. they are going to ring me and give the specific paragraph to use for the request because CCA is as thick as a telephone directory.

after reading info on this site ive decided to go ahead and see if i can claim back the ppi on my loan its only about 500 but you know!anyway sent template letter 3 weeks ago and today received reply saying "sorry you feel the need to complain your complaint is being investigated and you should recieve reply within 4 weeks.............". just wondering how long they normally take and is this letter a good sign, or is the bog standard letter they sent to everyone who complains?0

FSCS Response to my email about Picture Finance.....
The information in my previous response is the current correct position.
As the fund of last resort your complaint is correctly with us and not with Target, who from the information currently available, are only responsible for the ongoing administration of loans which were with Picture Loans.
I am sorry but there is nothing further I can add at this time, and thank you for your patience whilst we complete our enquiries. We will only be able to advise you further once our investigations are complete. Although the firm has ceased to trade this alone does not automatically mean the firm can be declared in default by the FSCS. I can confirm that we are in the final stage of our investigations into firm to see whether it should be declared in default. This will depend not only on its solvency but also on our investigation of a number of claims against the firm to ascertain if there is a claim that is eligible for compensation under our rules. However as previously explained our work is reliant on information from a number of other parties who are not under our jurisdiction.

12 months and counting....At the least the car I'm planning to buy is getting cheaper by the day thanks to the desperation of the Car manufacturers. I wander if they'll have to wait as long for their cash? somehow I doubt it!!

hi Marshallka and how are you today. Need some advice. In Natalie6999 post she states she has a copy of the ppi terms and conditions I never received such a book. Do you think I could request one0
