They have said as it was back in 2003 they are unable to listen to the tapes and disagree that I have been missold the ASU and can take it up with the financial ombudsman if I so wish. They have also sent me my signed contract (which I had already).
What shall I do next? feel like giving up
If this a final response then you can make the complaint to the FOS but where they say about the tapes (being 2003!!) they should have these records as it was within 6 years so again they may be fobbing you off.
As this complaint is about an incident that happened prior to 2005 sometimes the FOS does not have jurisdiction over this unless the company were a member of the GISC or Banking Ombudsman etc. It may be worth ringing the FOS beforehand and asking if they came under their jurisdiction though and they will tell you there and then. If it is that they were members of the GISC then they will also give you a complaint ref number and sent out the complaint form for you to fill in.
I will try and find out for you but do not give up. Its just what they want and you have to keep fighting...0 -

This was my first response back however I did call the ombudsman and they have said they will send out a form for me to file my complaint.
Is it worth writing again to Intelligent Finance?0 -

Dear All,
Is anybody else getting really bored waiting for the FSCS to sort out Picture Finance.
I began reclaiming my PPI back in October 2007 and after Picture had delayed for 2 months I eventually began proceedings through The FOS. Back in July I was informaed that Picture had ceased trading and that my case had been passed to the FSCS...
My PPI is a single premium policy to the tune of £11,000 and I'm still waiting to hear if I stand a chance of seeing that cash back.
The FSCS have had the case for over 4 months now and they still have not declared Picture 'in defalut' so I'm stuck in limbo! Do they have any guidelines on timescales they need to adhere to..?
Does anyone have any advice?0 -
