    Have they given you the opportunity to write to them again with further information?, if so then write again and tell them you are not satisfied with their response as you strongly feel you were mis sold on this PPI product and only became aware of these issues since reading in the media which gave you the opportunity to check your paperwork, and where you realised this was added, and give an explanation to what they have said above if you can.
    Also tell them if they do not uphold your complaint, you will take this to the Financial Ombudsman Service for them to investigate.

    When they get back with another response, it should be the final decision, which should enclose the leaflet of the Financial Ombudsman service, so if unsuccessful again, then I would then go direct to the FOS in order for them to investigate this.

    Hi Di and thanks for advice...

    They said that they were afraid that in the absence of any furhter infor from me they have no alternqative other than to reject my complaint. They then go on to say 'I am sorry if my decisions are not more favourable to my complaint. Should I wish for the FO toindependently review my rejected omplain I must write to them within six months (leaflet enclosed). In the meantime I await the information requested above.....

    So I guess, she is saying if I have any further info I wish to add then I can write back to her?? I think I will write back again with my further bits of info and with some of your bits of info too DI...What do you reckon?

    Of course use the further bits I have added hun, your most welcome.;) :A

    Now if they have suggested the FOS maybe if you want then you can go now on to them, its up to you, or write back to Lloyds to give them another chance to reconsider your complaint.

    May I ask how long it had taken to receive your first reponse from lloyds in order to know how long they would have left on this 2nd letter to reply to you.

    For instance they have 8 weeks in full to respond, if they replied within 4 weeks as from your first letter, then it will be another 4 weeks they have and so on.;)

    It has taken about 2 weeks Di for this letter to come through. So, I think I will write back (will get it in post tomorrow), and see what happens. Then if I still have no joy it will be the FOS:-)))

    Right then okay hun, call it 6 weeks they do have left, although they may even get back before that with a bit of luck.

    I also wrote back to them with a 2nd letter, even though mine was not successful again but now as mine is with an adjudicator, he believes it should be upheld, so hun you have a good case here and hopefully you will be successful after the 2nd letter.

    Good luck, let us know when you hear, so we can guide you to the following stage, maybe we won't have to if this is resolved, but you know where we are.;) :A

    Hi guys remember me? (.....erm no! :rotfl: )

    Well I sent my letters off today for OH to try and reclaim ppi on his credit cards and loan. It cost me a few quid at the Post Office and I could hear people behind me tutting at how long I was taking but I'm glad I have finally got round to sending the letters off.

    I used the standard template one for now with the reason for mis-selling as OH is self employed, we'll probably get letters back telling us to :mad: OFF but hey it's worth a try.

    We are on a DMP at the minute and hope it doesn't sound wrong but any money credited to our total will be a bonus so I'm up for the fight! :p I have found old terms and conditions for Halifax loan which we took out in 2006 and it states about paying out for self employed if your business ceases to trade, well OH never owned his own business so please wish us luck.

    I feel daft trying to fight it out now and admit its solely because we started to struggle with payments but we never truly fully understood the meaning behind ppi until now, I know I know, should have read the small print, should have done a lot of things but hey ho! :rolleyes:

    If you are self employed then you are classed as having a business. Most policies pay out for self employment if you pay class 2 national insurance as most self employed do. Where they say "business ceases to trade" they mean your self employment (as you are not employed by anyone else other than yourself).

    If you have other reasons why this is missold then it may be better to add them but if not then you may run into problems just using the self employed thing.

    This should not matter to your complaint about misselling at all. If you win with the misselling then you would get put back into the position as if you never had the PPI at all.

Miss T is aware the unemployment cover would not be in place at present due tothe redundancy being possible. Howevr explained that any new job after 6 months would be as per the loan protection policy.

    I dont know what the above is all about really, as I said it is not even signed. No idea what the redundancy stuff is about. I did mention when taking out my last loan in May 05 that there was a good possibility that I would be made redundant but that if I was I would be paying the loan off in full as I knew I was going to be getting approx £34,000 if I was made redundant ( I was in the end in Mar the following year and I did pay the loan off in full).

    So folks....what should I do/say now? Is my case strong enough by just saying they said I had to have to PPI with no acutal proof of that? The letter they sent me ended up saying if I wanted to take the complaint further I was to go to the financial omudsman.

    Any help would be most gratefull....I so so want to take this further!!!

    If this is their final response you can now take the complaint to the FOS. You can ring them and get a reference number (and they will send out a complaint form) or download the complaint form online.

    There is a long wait for the FOS at the moment and its about 9 months odd but can be well worth the wait in the end.

    :T after goin to fos i hav just receiced a letter fron N rock saying although they firmly refute that i was mis-sold the PPI on my loan they would like to reach an amicable resolution and on that basis will remove the PPI from my loan and refund the premiuns and intrest total £854.50 and pay 8% interest total £115.99 and rescedule my loan at origanal rate of 5.8% for the remaining 10 mounths and should i accept the refund will be payed when i finish the loan . Now should i accept this and wait or ask them to pay my refund immedatly:confused: thnks every one for your advice:beer:
