    The wording is:

"Paying a single premium for your policy does not constitue a mis-sale if insurance; it is ismply an alternative method of paying the preium. However having reviewed the sale I am not satisifed with the recommendation made by our customer Account Manager. During the call, you informed us that you looking to settle the loan within 2 years. Taking this into consideration the policy was not suitable due to the non proportionate rebate provided.

This is well below the acceptable standards expected and it has been raised with the individual concerned. Due to the seriousness of this incident, the individual may face disciplinary procedure and as such I am sure you appreciate I can comment no futher. As a company that prides itself on world class service, I am at a loss to explain this unusual lapse in service standards and can only put it down to human error.

In light of my findings, we would like offer a full rebate of your premium (£10,815) less the rebate you received when your loan was settled earlier this year (NB..there was no rebate) As the broker, we are unaware of the rebate provided by the lender; please could you provide this information at your earliest opportunity to enable me to calculate our offer.

Please accept this letter as our final response regarding your complaint. If you are not fully satisfied with our final response, you are entitled to refer your complaint to FOS....."

Is it worth pursuing? Or should I take the money and run?

To anyone who is reading: write the letters they cost nothing...follow some sage advice here and get back the money that's rightfully yours!

    Hi there
Even though it seems a nice amount of money, I agree with Marshallka here, it seems low for what it was etc, I am sure Marshallka will come along at some point here to go over this for you.;)

If they agree to mis selling, they should put this back right as if you did not have this in the first place, plus interest and generally 8% interest on top again of what a court would award.;)

I may be wrong and will have to check but I am sure you will be able to continue with the FOS to have this investigated.
The adjudicator is dealing with mine right now and not a problem with jurisdiction, with banking issues I am sure its not a problem, maybe someone else will be able to confirm this for you here hunni, fingers crossed, but in my opinion it should be okay.;)

Found in the FSA register search MBNA that they were authorised in 2001, A&L have so many banking authorities as it seems.
204487 - MBNA Europe Bank Limited

    AuthorisedEffective Date:01/12/2001

Maybe its A&L you would have to go through here to complain then.

Hi Di, Yes fine thanks, how's u?

We have nothing at all on this loan, once repaid I saw no reason to keep it! It was a printed list of conversations and nothing useful at all. What I find odd is that I rang a few times as well as writing and they did agree to send, no mention of age of loan at all then

    Not too bad thanks hun.;)

Damn! so nothing interesting in the transcript of telephone calls then on PPI ?

Its so frustrating not having any paperwork.

Did you say you have wrote to them again about this or rang them?
If you rang them what did they exactly say?

  • hi
my complaint went to alliance and leicester originally they passed it straight on to mbna saying it had nothing to do with them any more.
  • Thnks very much for the advise.
I will look on the link you gave me.
I did send a couple of the letters recorded delivery so i will get the reference numbers.

    Hiya hun
Hope you hear from them soon.

As you know they have a full 8 weeks to respond to the first letter, did you post by using recorded delivery?

What I would say when the 8 weeks are gone and you have not heard then complain to the Financial Ombudsman Service, on the complaint form you just add that you waited the 8 weeks but not received a response to your complaint dated XX/XX/XXXX, this way the FOS will still look into this for you.
    Check this out here:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

You will find downloadable complaint forms on the link, or alternatively ring them for a hardcopy through the post, and enclose copies of evidence to support you case, even copies of letters you sent A&L.

    Good luck
