This is not a final response but if it is 8 weeks since you first complained then you can go to the Ombudsman now but as you state it is 6 weeks there is still time to make a final plea to them. I would reiterate your complaint here and ask them for a final response. Add as much as you can to this letter and wait for their response. And yes, definately add the demands and need that was filled in by someone other than yourselves..

Good luck..(don't forget to post recorded delivery too)

Thanks for your help. Will send them another letter.

    Hi,

Unfortunately I didn't send it recorded delivery.
Right, maybe they have not received it then?? You may have to start over again here and this time send it recorded delivery...its up to you as to risking waiting another 5 weeks or send another.

Ah, I see it now - sorry, I replied too soon!

Thanks. I will write to Dixons then, mentioning that Cetelem told me it is their problem. Should I send a SAR (to speed things up?), or just the first letter from Martin's article again?

Thanks again, I really appreciate your time.
I would not request a SAR yet as there is probably not a lot on this if you were sold from Dixons...a SAR is only all the information that Dixons hold on you and if you bought it from a store then there would be no information about the sale for you to use against them. (ie telephone convo's etc) I would just write and wait for their reply.

Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

Don't forget to send this recorded delivery so you always a proof and dates etc.

After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

  • I need some advice

I originally took out a mortage with Northern Rock and thought I needed to take out the PPI in order to get the mortgage - I was only 22 so a bit young and nieve, I have since borrowed some money - £10K which was secured and £10K recently unsecured

Does this mean that I am double paying for insurance and if so how can I go about trying to reclaim..? Also I pay £90 a month for the PPI which seems an awful lot do you think I shoudl try and write to them and say that I have been mis sold it as I wasnt told that I coudl get the PPI elsewhere and cheaper?

Yes certainly do a letter for misselling if you were not told you could buy it elsewhere...Have you got copies of the agreements still and are the loans still active. Also when did you take these out?? If so much is secured and so much unsecured are they on seperate agreements...

You can request copies of the agreements under section 77/78 of the CCA and they have to send them to you within 12 days. If you have not got these I suggest you send a letter to request them and then you can see if you have two loans and PPI on each one. Don't forget to send this and all correspondence by recorded delivery as then you have a proof and dates etc.

Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

  • This is the main body of a letter i sent to the TSB on the 14th Nov 09,

I purchased the above policy from you in 17/03/05 but now believe that I was mis-sold this policy for the following reasons:

This is due to the fact that I was not given the correct information when the policy was sold to me, as
    • Your salesperson implied that taking out the policy would assist my credit application.
    • your salesperson did not give me full information on what the policy would and would not cover, for example that the Accident or sickness cover would be invalid as a direct result of War and civil commotion:
War, invasion, hostilities ( whether war declared or not ). This troubles me because I had earlier been asked what my job was and who my employers were, to which I Answered Soldier and British Army. Clearly in this employment, I get involved in the for-mentioned activities and have done so whilst holding this policy, which would have been invalid should have anything happened to me.
    • i am concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.
They sent me a letter back to day 19 Nov 09, replying to all apart from the bold under lined bit . Informing me that they are rejecting my complaint

Does anybody think i have a case and should go on

Its before and after school club and the one I applied for was 7.30 morning to 9.00 two days and 8.00 to 9.00 3 days and then 3.00 to 5.00 after school and was permanent. Now they have changed it to 7.30 morning to 9.00 every morning and 3.00 to 6 afternoons. (and only MATERNITY leave!!!) I Have had a word with my hubby and he is iffy really... It would mean not seeing the little un at all as would have to leave at 7.00 in the morning (on foot) and then get back at 6.30ish at night. May have to think long and hard. Also they want someone that can do the playgroup in the day as and when and school holiday club too. I just don't know if it will all get too much for now with everything else. I know that sounds stupid but I find things difficult now.. . It does not start until January so lots of time to think... .

Changing goal posts it seems. What seemed a good idea at the start is probably not so good now. Have a think about it Karen it may not be ideal. Am sure you will make the right decision.
