  • Hi everyone. This is my first post on this site so please bear with me if I am not doing it right!!

    My situation is this :
    Took a loan out in 2000 with my husband (now my ex-husband) with Nationwide. Was sold PPI even though we both had pre-existing medical conditions so I am claiming that it was mis-sold on this basis, and also because we were led to believe that it would assist our loan application if we took it out. Also PPI only covered first person on loan i.e my ex-husband.

    Complained to Nationwide and was given final response to say basically you had terms and conditions and you both signed!

    Have filled in comlaint form to FOS but have received it back so say 'it appears that both parties have not signed form. Please ask Mr N to sign form and return'

    Can anyone tell me if they too have been in this situation. Mr N went to work abroad 4 years ago to avoid paying maintenance for the children and basically left me high and dry with large mortgage to pay, etc so I have no contact with him. It is me making the complaint for mis selling so does FOS still need his signature on complaint form?

    Any help with this will be much appreciated.

    Hello and welcome.;)

    I would contact the FOS and explain your situation, they should be able to clarify this for you, I take it both names are on the complaint form?
    And to my knowledge you can complain on someones behalf but I think they have procedures they use for this, also try checking this out on the FOS website, this may be of some help for you, but ring them anyway and see what they have to say, good luck.;)

    I am expecting a refund from Halifax for mis sold PPI on a 20k loan from 2006. It was taken out beginning of May 2006 and settled on 29/1/2007 (remortgaged)

    The amount repaid was £30,828 with PPI included in that total.
    Halifax have agreed to refund the PPI plus 8% - does anyone know how much PPI is generally on a loan of that size, I think the interest rate was about 6 or 7% at the time. The loan was over 7 or 8 years.

  • Molly, as the loan was in both your names, then both parties would have to make the claim, as were the FOS to decide in your favour both parties would be eligible for part of the refund hence the requirement of the signature.

    Depending on the conditions of your divorce settlement you may be able to argue it, however I would strongly advise that instead of the FOS, you should seek legal advice on this matter.

    I assume that the loan is now paid off.

  • I wonder if anyone out there can help me? Back in January I contacted first plus about ppi and they gave me a choice £2000 good will gesture (original ppi was for 7000) or go to fos. At the time the £2000 seemed like a good offer so I took it after signing a disclaimer. With hindsight I feel that I have once again been taken in by this company and would like all of my money back! Because I signed the disclaimer have I now signed away all rights to getting all of my money back???

    Would appreciate some advice please

    It really depends on the content of the disclaimer, and what exactly you agreed to.
  • Hi, I think you are all great on this site, and the determination shown is fab. i was wandering if someone could help me please. i wrote to ge money on 28/1/09 to reclaim the ppi. (i took out a debenhams card in 2006). I have to osay that their response was quick, i got a letter back dated 29 jan 09. they advised in a nut shell that they cant pay back the ppi as according to their records one of their advisers sold it to me over the and i chose the ppi. therefore they can find no way of mis selling. i was thinking of writing back and asking them for a copy of that call. do you think that would be a good idea. they also say i knew about it cos it is on my statements. please help, i have loads of other companies to write to as well, and would love to get some money back especially in these hard times. any response would be greatful. thank you and regards.
