    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.





    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

  • I'd add to that PPI cover usually only pays out after an inital exclusion period - usually 60 days, but sometimes 30. Phone them up and let them know that you will be submitting an insurance claim and that you will need a claim form sent out to you. They will ask for your former employer and the Benefits Agency to sign that you are a claimant so don't delay getting in touch with the Benefits people or it could mess up your PPI claim (I found this out to my cost!). Same with council tax benefit.

    If I can ask, what was the loan for?
    Almost debt-free, but certainly even with the Banks!

    I have been trying to reclaim my PAP back from Barclays. After cancelling my PPI i noticed a charge of £8.50 a month for PAP.
    So i called barclays and they advised it was a personal accident plan which is for accidental death and injury.
    So really it is very similar to a PPI.
    They told me i had to go through the broker UNAT direct. So i did that.
    They sent me a letter saying as i agreed to it i could not claim and they had a recording of me agreeing. Which i then asked for.
    Even though i did agree to this, i really dont think iw ould have understood it properly and thought that i had to have it.
    Am i still able to carry on claiming and if so what should i do next. I am so annoyed that i have been paying £8.50 for near on 10 years when i did not need or want it. So in reality ive wasted over £1000.

    Any help and advise would be great

    Thanks for your advise. They did claim in their letter to me that I could go to the FSA. I will send another letter like you have advised and wait and see.

    Although I design all sorts of spreadsheets for different solutions--this one was an adapted one from a template in Excel.

    Just:

    FILE|NEW|at r/h side click on templates on my computer|SPREADSHHET SOLUTIONS|LOAN AMORTIZATION

    One can get rough figures using this, but I "unprotected it" and modified it to

    1)use AIR from APR & use Compound Interest
    2)Added facility to use changing rates
    3)Automatically calculate 8%
    4)Add facility to include Arrears Charges etc
    5)Added facility to apportion premiums if only total premium known

    I've got a bit to do to include a facility to remove entries after a set number of pymts & include the totals at that point (I did it manually on Marshaalka's & Nicks)

    If I'm claiming back PPI on a Debenhams store card, does my claim letter go to Debenhams or to GE money who finance the card?

  • I would agree with you it would be debenhams in the first instance. They will either refer you to GE or tell you that it was sold correctly and you can go to the ombudsmen.

    However if your statements are from GE then you would go to them. Eitherway in the first instance get a SAR from them.
