    Shelter is a housing charity - it's not just for homeless people.

    They have a lot of knowledge of housing legislation and can give free advice about your rights and possibly about getting a stay of execution. Take the morning off work tomorrow and call them and the CAB. Good luck.

    I feel really sorry for you. You are a good honest citizen who has NOT stretched yourself beyond YOUR means, indeed, who KNEW your means enough NOT to stretch yourself, and YET, you are the VICTIM in this.

    He's a BTL'r and a bit sensitive, I just call a spade a spade, the OP is being screwed because of the lax law on this type of business. It needs to be regulated and regulated hard.

    Problem is that a lot of landlords who fall into difficulty are people who have moved out of their own home as they can't afford to stay and can't afford to sell due to negative equity. They have moved in with family or are renting somewhere cheaper themselves. A lot do not have consent from their lenders to let the property. Its all well and good saying that the banks should give tenants the protection of the AST, but the banks often think the mortgagees are still living in the place.

    If banks had to let tenants stay, even when they don't have consent to lease, anyone facing a repo would claim that their cousin was a tenant and keep the property, rent free for another 6 months.

    With a BTL or consent to lease mortgage, the lenders has acknowledged the tenancy and so is required to allow the tenant to stay at the moment.

    The big problem is that a tenant has no way of knowing whether their landlord is letting illegally or not. I would like lenders to issue a certificate confirming that the mortgage has consent to lease/ BTL and the mortgage is paid upto date. Then every tenant and letting agent could see where they were at.

  • I read all the responses with interest. I wondered if via Shelter or another mediator if the poster could come to an arrangement with the lender to pay the rent direct into the mortgage account so that at least some of the mortgage interest is paid. Obviously the landlord has a lot of arrears but this solution might at least prevent homelessness and the cost to everybody of court proceedings. Just a thought.

    I have 2 small children and married. I can imagine the stress you are under. Especailly with the kids in school etc.. I really hope you find somewhere nearby to rent.

    Life is a b***h at times. Go at it with both hands and MOVE a soon as possible and definatley stop all rent!!

    Keep us informed how you are getting on.

    Mentioned to new letting agents whats happened and there maybe a nice understanding landlord that will aloow pets in your circumstance especaiily as you have paid all your rent payments,tax, and bills.
