thanatos.you like all dwp officers forget to state that virtually unable to walk is not the only criteria there is a second part.that is distance walked without being in pain.
Nope - they are one and the same thing - it's how far you can walk without being in severe discomfort - be it pain, breathlessness etc etc it all falls under the catagory of virtually unable to walk.

Quick question my husband suffers a non freezing cold injury that has destryed all nerves in both feet, not supposed to go outdoors in cold weather, need pyhsio, get trench foot after having work boots on for too long in the day, his condition is permanant, the army cannot discharge him over it because they have already admitted responsibility and to discharge him will cost them a lot of money, he suffers severe pain, needs to wear special cold weather boots at all times, is kept indoors through winter months as not to expose his feet to cold or wet weather, it affects his walking. If he was to put a claim in for DLA would they know what the injury was to make a decision, he sees one of the leading specialist every 6 months and goes through extensive tests at the naval institute, but if dla use a computer to bring up effects of an injury how can anyone say he has a problem if they have no idea of the condition in the first place? is it worth a try. We have so much medical information of what he can and cant do, etc.0

It is up to you to provide enough information to the DLA to enable them to decide in your favour. The decision is not made simply on what diagnosis he has, but on how his condition affects his mobility/ability to care for himself. This means that the more documentary evidence that you can get in support of his claim, from his specialist/physio/OT etc the better.
The claim form is long and complicated, to give yourself the best possible chance of success, you need to seek specialist advice from a welfare benefit adviser / CAB adviserI'm a retired employment solicitor. The form is very difficult and wondered if you could help me in the part where it wants you to add tasks that they have help with, is this in addition to the washing etc...already covered or do you list it all again. I really am struggling with this. Any help please!!0

PLEASE get help and advice to complete the form from a welfare benefit adviser or the CAB I cannot stress enough how important this is, it really can make all the difference between the claim being successful and not.
As far as your question is concerned, I have always completed each section as a stand alone section - in other words if something is relevant to the 'stairs' section and also the 'night' section, I give the same info in both parts. It can lead to a lot of repetition, but rather that, than have an important fact overlooked.I'm a retired employment solicitor. Unfortunately it can be weeks and in some cases months (my son's recent claim took 4 months, but that might have been because they lost his file!). If you have not heard anything after four weeks, I'd ring them and then ring them on a fairly regular basis until you hear. If the claim is successful it will be back dated to the date the form was sent to you, provided you have kept within the time limits.I'm a retired employment solicitor. I was wondering id you could help me.
I lost my mother 3 years ago and I stayed in the house which is rented.
I am on low rate DLA and incapacity benefit. I have been now for many years. I have won 3 tribunals to get my DLA.
I have been informed that I can not claim income support unless I am on the middle rate DLA ? I went to my local dhss and told them what I get to which he replied " I honestly don't know how they expect you to live". I am finding it really hard to survive.
I have to pay half my rent and council tax and I keep getting summons's because I cant afford to pay more than what I do.
Is there anything that can help me get income support or middle rate DLA?
All help greatly appreciated and thank you in advance for your help.
