Online ordering - item still not received

I ordered a mobile phone battery online on 29 Sept. They immediately took the payment from my account. A week later, having heard nothing, I chased them and was told the item was out of stock and would be sent the following week. It wasn't of course.
I have since sent them two more emails, the last one stating that if the item was not immediately despatched could they please cancel the order and refund my account. I have had no response at all.
What the hell can/should I do ? :mad:

How did you pay? If via paypal you can start a claim, if via Visa card then you can contact your card provider and see if they can help (though if its a small sum they may not get involved)0

I would send them a letter now, recorded delivery, stating they have 14 days in which to refund your payment. If this fails, then send them a "letter before Action" along the lines of the template below:Date…….
Owner / Manager's name (or The Manager)
Retailer’s name
Retailer’s address
Retailer’s postcode
Dear [owner/manager’s name or Sir/Madam]
Final Notice before Legal Action
I enclose a copy of the letter I wrote to you on [insert date of letter (s)]
I have given you a reasonable opportunity to resolve my complaint. You have failed to do so.
I have now been left with no alternative but to seek legal redress through the courts. Unless this matter is satisfactorily resolved within the next 14 days I will instigate legal proceedings without further notice. The cost of this action will be added to my claim.

If you dont get the refund you then need to register with moneyclaim on line:
https://www.moneyclaim.gov.uk/csmco2/index.jsp
Its small claims court, but made a lot easier now. There is a charge (I think its about £30) but you will get this back in your final settlement.
I cant stress enough though the importance now to send all contact via recorded delivery, and keep copies of everything you send.

Call your bank & dispute the transaction - I've done that before & they sorted it out for me - good luck!nothing to see here, move along...0

Report them to your local Trading Standards office too.
