Am i being paid under the national minimum wage?

  • my pay fluctuates by how many days are in the month....or how ever much they decide they can spare.

    last month was 796 before tax and 701 after, last month was 691 after tax...before tax i am unsure as my payslip is in my desk drawer at work
  • I dont understand why theres TWO national insurance payments coming out of your wages?

    if your working for minimum wage then this month your wages should be:

    23 (working days) x 7 (hours in a day) = 161 (hours)

    161 (hours) x £5.73 (new national min wage) = £922.53

    So seeing as its near the end of the month i would wait until you get your pay slip and if the basic wage isnt 922.53 i would ask why.

    Tell them you was working your wages out (xmas is coming everyone needs to know what they have spare to spend!) and that you expected 922.53 (before tax) and enquire why it wasnt given.

    Check the two N.I contributions tho because thats not right

    I will do...i thought employers N.I were contributions the employer had to pay, maybe i'm wrong

    The second NI figure is a statement of employers NI paid and is not deducted from the gross wage.

    Unless you are completing time sheets you cannot calculate it like this. But then it would say the number of hours. Or at least number of days, not basic pay.

    It is calculated : basic pay (annual) / 12 months = for monthly basic pay
    Otherwise all office people would get paid different amount every month and that is not possible.

    It is difficult to say unless you have some kind of contract stating the figures.

    It sounds like your accountant might not have an idea what he/she is doing...

    I think the best course of action is to request your contract. Maybe say I'm trying to sort all my paperwork out at home and realised I hadn't got it yet - then its not accusing.

    Once you get that it will be clear whether it is per hour (in which case you should be completing timesheets) or whether it is salaried. Once you find out we should be able to provide more helpful advice especially as the contract will state your rate of pay.

    What a mess - and you say these people are solicitors!

    1. Be very very careful as with less than 12 months service you have no protection from unfair dismissal - if they don't like you asking questions you could be out the door on the spot with no come back.

    2. Watch that 6 month contract business - its designed to give them freedom to get rid of you - however as they haven't yet given you a contract stating a 6 month term, you would be well placed to argue in an employment tribunal after 12 months that you understood the position to be a permanent one and that therefore you were entitled to normal employment protection. In a sense therefore not having a contract is a good thing at the moment.

    3. That said you are legally entitled to a contract of employment and they should have given it to you by now! This is a breach of the law.

    4. On any measure of 7 hours a day, 5 days a week they are underpaying you. If you can, ask amiably then it is worth asking "how they calculate from the £5.52 to your gross pay" - don't make any comments about breaching the minimum wage. It maybe worth waiting to see what this month brings because the change in rates would naturally see you expecting to see a change and be a reasonable point for you to be looking more closely without suggesting you don't trust them.

    You have a tricky tactical hand to play here - my feeling is they know exactly what they are doing and that is taking advantage of a naive (sorry!) new employee with limited rights using their position as solicitors to make you feel that of course they will get it right.

    As an absolute last resort - if it becomes clear that they have abused their position and your inexperience then I would consider reporting them to the Solicitors Regulatory Authority for a breach of professional standards.

    Deliberate breaches of NMW legislation will be investigated on a no-names basis by HM Revenue & Customs.

    But it could be a mistake. Is there someone at work you trust & could ask what they think? Have they got your hours wrong?
