  • Was the CA sent in responce to a formal CCA request, if so did they supply everything, credit agreemant, terms and conditions relateing to that agreemant, a statement of account?

    You still need to see what the amount on the claim form is made up of, and if penalty charges have been added and included in the claim.

    I would still send both those letters even though you may have the CA, if nothing else it will confuse them:p

    claim forn includes sols charges and court costs, do you really think it would be to late if BR next week and then returned claim form to sols either just before or after

    You dont return the claim form to the solicitors, you send it to the issueing court, just to clarify ,is the claim you have blue with the court stamp like this-

    Obviously the court may differ but the form should be the same, and should have had 4 pages or so

    The amount claimed may include unlawfull charges, but its not that important if you have decided to go ahead with BR.

    If so after yopu have filed AoS on line contact the court listed on the form after your BR, inform them you have gone BR and ask for the case to be suspended/stayed, as you are no longer liable for the debt, but dont want it to go to judgement by default anyway,

    will send of the acknowledgement to get extra time and will go BR next weds will call the court afterwards, onlt niggle in my mind is if the OR thinks that our mortgage is to high and makes us sell and go into rented, mortgage reduced from 01st Nov to £780 + £118 for secured will he say that we can rent for about £650-£750 what do you think

    You already know i cant say for sure but waying up the costs,shortfall of selling the house and thus increasing your debt in BR against the gain to your estate by making you move out and rent, which would require a few thousand up front for rent and bond etc, i would say it is somewhere between doubtfull, to no chance with such a small differance.

    You dont need to file your AoS yet by the way, i would do that after your BR date, just in case you have any last miniute problems, that way you maximise your time frame before it actually gets dealt with in court, just in case, it never hurts to have a back up plan;)

  • Looks like this company has a habit of send out notices....

    I got two letter today in the same envolope, one with Orange logo and the other with Arrows Global LLC, telling me that I owe them £50.81.

    First time I have ever heard of it and them, but on calling them they say it is from an Orange phone contract back in 1995..

    I have to prove it is not me, question is that the case
