    I had a debt of just over £5000 on a credit card, which the credit card company sold to Arrow Global. Arrow Global then used a solicitor Bryan Carter to CCJ me for approx £375.00
    I thought this a bit strange but I was ordered to pay £50 a month.
    In the mean time it was passed back to Arrow Global even though I had been paying regularly but still have £25 to pay to satisfy the CCJ. I emailed Fredpay (who take the payments for Bryan Carter / Fredrickson) and they said if I pay to them £25 they will inform the court that the CCJ is satisfied.
    Should I send them a payment? Arrow Global havn't updated my credit file since January 2009 and as I havn't been persued by anyone for over a year now I don't really want to approach them. Also I can't understand why I would get a CCJ for a percentage of the debt?

    Sometimes, when a debt is passed to a collection company, they will accept a reduced amount to settle the debt as a lump sum if it has been ongoing for a long time.
    However, I do find it strange that you are only being asked for £350 for the CCJ if the original debt was £5000.
    Are you sure this is not an additional debt with the same collection company you could have overlooked? Have you checked your credit file?
    You could ask the creditor for further clarification.

    However,if they are saying that £25 will satisfy this CCJ,I would ask for a receipt and confirmation in writing that the CCJ is satisfied.
    This receipt is evidence to the court that the full balance plus costs has been paid.
    The court will then notify Registry Trust who will automatically mark the entry on the register as satisfied. This will then be passed on to the CRA.
    If you require proof that you have paid a judgment, you can ask the court where the judgment was made to provide a ‘certificate of satisfaction’. There is currently a fee payable of £15 for this.

    Hi nataz and thank you for your message

    If the creditors have not stopped interest and charges, then the interest on any savings you have is usually lower than the interest being charged on the debts,
    And therefore it makes sense to repay the debts first and then look at continuing with savings once the debts are cleared.

    Any savings in your name we would need to be aware of, as it could affect the advice we give.
    However, any savings belonging to your children, in their names,that you are not paying anything into, should be fine, as long as the savings are for their sole benefit.

    Thanks, sorry for the double post. Seems like as soon as I sit down I think of another question!

    I was considering putting money for stuff that doesnt get used every month such as hair, clothes, dentist etc into a savings account linked to my current account, that way I dont spend it on something else and I can easily transfer the money back when its required. Is this ok? Probably a silly question but I normally like to have different accounts for things like food, petrol etc. It helps to stick to the budget.

    I shoudl probably ring the help line but its easier to just post things when they pop into my head. Thank you for all your help

    Quick question, I hope this is the right thread. I ordered something from a company but missed the last payment (of two) and they have since sold it to a debt collection company.

    I have since had more difficulty even paying them so proposed £1 a month, should they accept this? They have since asked for expenditure etc.

    Do they have a right to request such information? Or should they accept any I pay them?

    Hi,

    I've been on a DMP since March 09 - all creditors informed and a back up letter sent via recorded delivery to be extra safe at the time. HSBC are now getting in touch with me saying that they do not accept the payments and that they are not sufficient. They have asked me to contact their Financial Guidance Team. I informed them that I am on a DMP with cccs and will take advice from them and be doing all communications with their advice. I am concerned though about them hassling me. I have explained that I am paying what I can afford at the moment and offered to send them my cccs budget which was revised in August. I'm planning on contacting cccs directly but thought I would post here to alleviate my worries tonight! Any advice? Is there anything else I should be doing?
    BTW despite my sign in name I am now broke and fixing it, but don't know how to change the name!

    If you are on a DMP with CCCS, then you do not need to send these creditors any further correspondence and you did the right thing by telling them we are dealing with your DMP.
    If they are not happy with the amount we are offering, we will continue to send the money anyway. You cannot pay them money you do not have. You should not pay them any extra than what you are paying on your plan.

    They are not allowed to hassle you.

    You could ask them to take you off their telephone data base and communicate with you in writing only.
    I have attached a sample letter you could use.

    Dear Sir/Madam

    I am writing to ask that you no longer contact me by telephone as your calls are causing me considerable stress due to the frequency, and that they are being made at inappropriate times. Please remove my telephone number from your database and send all future communication in writing to my home address.

    I have provided the most recent copy of my income and expenditure to make you aware of my current financial situation. I will continue to make my payment of x on the x of every month and will keep you informed of any changes in my circumstances as I am keen to resolve this issue as soon as possible.

    I understand that following this request if you continue to call I can contact the Office of Fair Trading to make a formal complaint.

    Please confirm in writing that your records have been amended.

    Ok...here goes!

    My hubby and are around £80,000 in debt. We have spoken before re IVA's but because we can pay our monthly payments this is not possible, however the reason we just about manage to meet our repayments is because we a re renting our house from a relative at a really reduced rent .....this won't last forever and we are left with hardly anything to live on at the end of each month. One of our loans is over 30 years as is was attached to our mortgage, I just can't ever see our debt coming to an end, we'll never be able to save to buy a house and I really don't know where to go now.

    Have considered bancruptcy but don't have a clue about how that work and worried we won't get a mortgage. Only assets we have are our cars and we can't be without them for work. Just really can't see a light at the end of the tunnel, desperately need help so we can focus on enjoying our lives rather than having a panic every time we have to spend money.

    Anyone....please?

    hi guys,

    just wondering if anyone could offer some advice

    i got 2 loans while with my ex partner, both with lloyds tsb. one is a joint loan and the other is a sole loan together they total £10,000
    when me and my partner split 3 years ago it was agreed that we would both still pay our fair share as time has gone on things have got messy and to cut a long story short ....after many excuses and lots of lies my ex has stopped payin towards it, and now im left with all this debt plus a whole lot of interest which has been added, i have agreed a payment plan with the bank that i can afford on my own! but i was just wondering if anyone knows wether i have any options as to wether i can make my ex pay...or if iam just left with this debt on my own! the bank say it is not possible for them to split the loan so we both pay half as it has to stay joint....i just feel as though where ever i turn i hit a brick wall :confused:

    Hi there.

    Unfortunately there isn't much you can do about this. Any joint debts are classed as joint and several liability which means both you and your ex are responsible for 100% of what is owed. If you go your seperate ways the bank can choose who they chase for the money, and in your case they've come for you.

    Hi there.

    If your creditors all have branches you can certainly make the payments over the counter, they can't refuse payment.

    You could also ask your bank to do a transfer which shouldn't cost you anything.

    All went as expected. Payment set as we requested. Judge also wrote in they are not allowed to apply for Order of Sale.
