  • sorry im new to this so hope this is in the right place,i have 50k in unsecured debt i have spoke to cccs who have recormended a debt management plan,i am on a joint mortgage but the debts are in my name and am unsure about my house will i lose the house[this seems unfair on my partner] i have been told to be carefull about dmp as the crediters use these to keep payments coming in then going behind your back to get your house is this true,has anyone on here in similar circumstancies on a dmp at first it was like a new life after talking to cccs but now i am back to sleepless nights

    It is better that you send a financial statement as this will back up your situation and they can see the reason why you are paying a pound. If they were to apply for a CCJ then you would need to supply this information at that point.

    Hi andyh123,

    You have taken advice on your situation and are in the process of setting up realistic, affordable payments to your unsecured creditors.

    As you probably know there are no guarantees with a Debt Management Plan (DMP) as your creditors do not have to accept what you are paying them. If your creditors are unhappy with an offer of payment then they will start moving down the collection process. The collection process, very generally, goes something like this:
    • the creditor will ring you and/or write to you and let you know that they are unhappy with the offer.
    • They will issue a default notice (a legal requirement, this is a formal letter telling you that you have not kept to your Terms and conditions).
    • they may pass the debt to a Debt Collection Agency (DCA)
    • if they are still unhappy may apply for a CCJ.
    If the creditor applies for a CCJ you will receive papers through the post and will have to complete your budget details on the form provided, and make a monthly offer of payment. As long as the offer is reasonable then the court usually sets payment as the amount offered. However, if the creditor receives a forthwith judgement (full payment due) then they may be able to apply for a charging order on your property.

    This DOES NOT mean that you would lose the house or will have to sell the property. By applying for a Charging Order the creditor is protecting themselves and ensuring that if you do sell your property that they get their money back. Once a creditor has a charging order on the property they are usually more than happy to receive a monthly instalment. As long as you keep up the instalment payment nothing further will happen.

    It is unusual for a creditor to go for court action if your offer is reasonable, if your offer is based on a realistic budget, and if you are consistent with payments.

    If you are still unsure, ring the client helpline number that was on the information pack sent to you. Believe me, a DMP does not mean that you will lose your home.

    Hi,

    I have just been phoned by a company called Consumer Credit Services, who have told me that my credit card is unenforceable because (a) my minimum monthly payment is a percentage of my balance and not a fixed amount, and (b) they have increased my credit limit without asking me first. He said that the balance can be written off because of these points. I have asked him to call me back in an hour while I look into it myself a bit more.

    I'm not struggling to pay my credit card (slowly but surely!) but it would be nice if I didn't have to...! However, I'm well aware that if it sounds too good to be true, it usually is. Could someone set my mind at ease that I'm not missing out on a massive opportunity to rapidly clear my debt here?

    Can someone give me an example of an unenforced credit agreement.

    What reasons are their that would make it unenforceable?

    HI ted,hope you do not mind me replying as i have just started with my dmp three months ago.I went into my bank with my credit card statements all from different banks and used the tear off slips on bottom of statement to pay my one pound token payment the first couple of months.If you go in your own branch where you bank they do not charge.
  • I filled out a Debt Remedy online form with CCCS. How long will it take to receive a phone call/contact from them please?

    Hi I just have a quick question, I haver been in contact with CCCS and have an appointment on the 28th. Im just arranging to call my creditors which an option to freeze interest/charges. I have £300 a month free to pay them, which would be £30 pm as I have 10, one of my creditors i pay £20 a month do i keep that as £20 or bump that up? Also a catalogue i have i am on a low apr with a fixed payment each month of £37.44, Do i still call them with the same question? Thanks very much . One last thing (sorry!) How to I word the question to the creditors about lower payment/freezing interest? So i dont sound stupid!
  • Hi i wonder if you can help i had a telephone appointment with yourselves at cccs on thursday as i was desperate to sort out my debt problems and was expecting to do a DMP however when i went through things on the phone i was advised that i should go for a DRO as my outgoings were so high and unlikely to change, there was not enough to pay off my debts.
    I have all the paperwork to do this but am worried what is the likelihood of me being refused the DRO and not be any further down the road of tackling my debt problem as i am so worried i will start getting knocks at the door. I tried to give accurate information to the counsellor but am worried in case there is something i have forgotten or recorded wrongly.

    How often dothey get confused, sorry but been up all night worrying
