    Postal Orders can work out a little expensive; you could make the payment via a standing order if you have their bank details. This way you are not paying any extra. I’m not too sure with regards the payments slips I believe that it may have to be that bank – I’m sure someone will correct me if I’m wrong.

    You should be given a booklet at the end of Debt Remedy with all your options. I would recommend that you give the Debt Remedy team a call. I will PM you their number

    Two examples of this would be:-

    If a creditor cannot provide the information, or prove that you owe a debt, they cannot take any enforcement action against you until they do.
    This would be if you had received a letter asking you for money for a debt you had no knowledge of, or if you disputed an amount outstanding.

    Another example is if the debt is statute barred under the Limitation Act.
    The Limitation Act 1980 sets out the rules on how long a creditor has to take action against you for a debt , for example, take you to court.
    The time limits are different, depending on the type of debt that you have. It is usually 6 years.
    Once the six year term has elapsed the creditor will be out of time or “statute barred” from suing for the debt if:
    The creditor has not already obtained a county court judgment (CCJ).
    The debtor or any one else owing the money (on a debt in joint names) has not made a payment on the debt during the last six years.
    The debtor has not written to the creditor admitting they owe the debt during the last six years.

    It wouldn’t really make a difference as it’s just a token payment until you have had your appointment. Your letter would not need to go into too much detail, you could put something along the lines of “I am currently experiencing financial difficulties and have an appointment booked with the CCCS on the 28th Jan, please accept my goodwill gesture payment of £x and stop all interest and charges on your account. I will be back in touch after my appointment”

    Thank you for your question.

    We would be able to send you sample letters if you wished to contact them directly to offer them full and final settlements. Depending on your situation you could also possibly look into a lump sum IVA as this would be legally binding.

    It is good to hear you are closer to a solution to your debt situation.
    I cannot say whether you would be refused a DRO without knowing your full situation, but if you have been referred by your counsellor then they must have thought you had all the right criteria.
    Just make sure that you do not have any extra debts you may have forgotten about.
    A copy of your credit file would should show if there any other debts . As long as the total does not exceed £15000 then you should be fine.
    With regard to ‘getting knocks at the door’, a collector does not have any special powers and is not a bailiff. A bailiff can only visit if you have a CCJ and you have not kept up the payments or you have ignored it.

    I you find the calls are getting too much you may want to use this letter, you still receive the calls keep a log of the dates, times and peoples names if possible and look at making a complaint.

    Hi - We are currently on a DMP with CCCS and we have 2 small debts of £600 and £175 in amongst our larger debts and we were wondering as we both do overtime whether we can pay these debts off individually if we save the overtime money? If so do we need to speak to cccs or can we just approach the company's involved?

    You would need to call our Debt Remedy team, information usually goes to the address that you give us or we could email the information to you and then you could just print it off.
