  • Ok I've been trying to get my debts down for two years by myself and I've done pretty well - I reclaimed bank charges, shuffled my debts, paid off my student and graduate loans - but as I'm self employed, work is sporadic and I can see things spiralling out of control again.

Here's what I owe in a nutshell - what is by best option?

    Egg loan: approx £9.7k
    O2 phone bill: £700
    Vanquis credit card: about £950
    Barclaycard: £2,450
    Frasercard: £800
    Capital One: £800
    Barclays overdraft: £2,700
    Total: £18.1k

(it was £25k two years ago btw so don't think I haven't tried!)

Repayments are around £610 per month plus bank charges
My rent and bills are £450 per month plus council tax
Earnings range between £800 and £1200 per month, so once I buy food/petrol etc, I have nothing (minus nothing!)

Any help or advice gratefully received.

    Hi
I was with CCCS until recently when they closed my account. Having spent 2 years with CCCS I found that because interest and charges was still being added, I owed almost as much as when I started. I’m 60 next year so the prospect of being able to pay off this amount looks bleak.
I therefore went to solicitors to see whether all the debts were enforceable. Some they have challenged and I put it to CCCS that whilst these items are being adjudicated upon, I wanted to concentrate on the debts which are enforceable.
I want to carry on paying the money each month to CCCS but for the money to go to specific lenders whilst the other are being sorted out.
I don’t want to hit 70 and be made bankrupt, If I have to become bankrupt because I can’t pay off the amount before retirement, I might as well do it now.
CCCS stated they were not prepared to pay specific creditors and closed my account.
If I owe thousands and can only pay so much each month, why can’t CCCS just pay the creditors which are not in dispute?
  • Hello, long time reader, first time poster etc etc.

Firstly I would like to extend thanks to CCCS for the general service they provide. I'm coming up to 3 years on my plan, my debt is coming down nicely and I really couldn't be happier with my dealings with them, it really helped my though the tough financial times I've been having.

I got myself into debt while starting a business, not being able to take a wage, and misjudging how quickly I'd see a return. Fortunately things have gathered pace and the possibility of taking a reasonable lump out is on the horizon next year.

My query is in relation to making further and final offers on settlement. I have a loan and a numbers of credit cards, only 2 of which defaulted me a couple of years back.

If I make an offer, and they are accepted am I likely to receive a default from the companies that have not already issued them in the past?

I am eager to get my debt behind me, but am concerned I'll start the clock on a new round of defaults.

anyone with experience of this situation, or CCCS people, your response would be appreciated.
  • Hiya,
my wife and I have been in Debt Hell for about 6 years now.
Finally took the plunge and called the CCCS today, hellelujah.
We're going to start a DMP asap.
Are Capital One known to freeze interest?? We have £2400 on Capital One credit cards and am worried the debt will never end :(
Also, am deep into the buffer on my Barlays account which costs me £22 every 5 days for the privelage.... am so worried about just stopping paying my debts, even though the CCCS counsellor said i should.....

    Thanks, Joe x

    Hi there,

I am looking to sort out my finances which have been in a mess for 3 years but I now have to get them sorted out! My money problems started and I was generally struggling to get them sorted, I was then in a serious car crash and lost any interest in getting them sorted so everything spiraled out of control, I just stuck my head in the sand!

I now have 2 CCJ's and a couple of other debts which I want to start paying back on a monthly plan but I don't know where I can find out exactly who I owe the money to and how I contact them. Are sites like Experian the way to go? I want to start some kind of monthly plan, starting low but hopefully as time progresses upping the payments until they are all gone.

Any help would be greatly appreciated!

  • Hi I have put info into the online debt remedy however my outgoings are higher than some of the suggested so I just put in the maximum amounts it recommends. The resulting recommendation was for me to start a DMP for £1957 per month:eek: for 4 years and eleven months. The problem is there would be no possible way I could pay this amount and was wondering if you could tell me is it possible to pay less over a longer period?

    Hello
I run my own online business - registered as a sole trader. After nearly 3 years now the business is still costing me more than it makes - setup costs got me into alot of debt and now I am in a position where I just can't pay them. I was going to go for an IVA but it still costs me more than I can afford to pay. The business is still running and with the new changes I am hoping we will improve our circumstances but currently my husband supports us all (2 young kids). I think that bankruptcy is going to be my best option but I'm confused as to what can be included in that and also how that affects my business - can I still run it (obviously I won't be able to get credit - and that suits me fine - thats what got me where I am now - and I never want credit again!), we have permanant residency here but are due to apply for our passports - will this be affected and can I included my business debt as part of my bankruptcy. My husband has a mortgage but I am not included in this - will he be affected?

    Please help.

    Hi samom1,

Thank you for posting on the forum.

If you are a sole trader the debts that you have, even the debts that have helped set up the business, will be in your name. All of these debts would be included in bankruptcy.

As far as your residency, I am not sure if bankruptcy will affect you. You would be best to either contact the Insolvency Service at http://www.insolvency.gov.uk/index.htm, or you could get some legal advice from http://www.communitylegaladvice.org.uk/.

Depending on your financial contribution, and a few other factors, the Official Receiver (OR) may decide that you have beneficial interest in your husband’s property. If there is equity in the property the OR may ask for a financial contribution to the bankruptcy based on the amount of beneficial interest they decide you have in the property. Your husband will be able to buy this and there would be no other affect on the property. This is quite a complicated area and I would advise that you take some advice.

If you would like to have a chat with one of our debt counsellors you can contact our helpline on 0800 138 1111.

    Regards,

    Amanda

Hi Everyone and thank you all so kindly for all your help and advice and support. you have all been so wonderful.
I sent off my details today with my signed dro request to CCCS, so now im waiting for a reply to see if Im eligible. And Thank you all teh staff at CCCS for they kind help and patience
While adding my credit card statement I noticed on it that I have been paying PPI or payment protection since i had the card.. But im a bit perplexed about something I agreed a fixed fee with the bank for £100 a month but they seem to be charging me out of that £48 for Payment protection,
So if my card is insured with payment protection and this is my stupid question then why doenst the insurance cover the whole thing. Oh is that me being niave and stupid again.
Im still very worried about the interest on my account as i was told not to pay anymore money into that account and to be honest there are so many rules that all i do is get more depressed thinking im going to make a mistake or do something wrong which is adding to my stress levels.
I have managed one afternoon out of the house this month so I know im getting worse and really dont know what to do about this did think of going to talk to an accountant for help what would you advise.

    Hi there,

Thank you for posting on this forum.

If you are applying for a DRO and meet all of the criteria, then all of the debt will be written off eventually. Try not to worry too much; I know that it is difficult.
