    I have had my paperwork thru from CCCS,
    In it there is reference to the contractual payments to creditors, which total £192 per month
    My payment now will be £120
    Will I get a breakdown of the share to each creditor or not. Its too late to phone now

    I run my own online business - registered as a sole trader. After nearly 3 years now the business is still costing me more than it makes - setup costs got me into alot of debt and now I am in a position where I just can't pay them. I was going to go for an IVA but it still costs me more than I can afford to pay. The business is still running and with the new changes I am hoping we will improve our circumstances but currently my husband supports us all (2 young kids). I think that bankruptcy is going to be my best option but I'm confused as to what can be included in that and also how that affects my business - can I still run it (obviously I won't be able to get credit - and that suits me fine - thats what got me where I am now - and I never want credit again!), we have permanant residency here but are due to apply for our passports - will this be affected and can I included my business debt as part of my bankruptcy. My husband has a mortgage but I am not included in this - will he be affected?

    Please help.

    Hi Everyone and thank you all so kindly for all your help and advice and support. you have all been so wonderful.
    I sent off my details today with my signed dro request to CCCS, so now im waiting for a reply to see if Im eligible. And Thank you all teh staff at CCCS for they kind help and patience
    While adding my credit card statement I noticed on it that I have been paying PPI or payment protection since i had the card.. But im a bit perplexed about something I agreed a fixed fee with the bank for £100 a month but they seem to be charging me out of that £48 for Payment protection,
    So if my card is insured with payment protection and this is my stupid question then why doenst the insurance cover the whole thing. Oh is that me being niave and stupid again.
    Im still very worried about the interest on my account as i was told not to pay anymore money into that account and to be honest there are so many rules that all i do is get more depressed thinking im going to make a mistake or do something wrong which is adding to my stress levels.
    I have managed one afternoon out of the house this month so I know im getting worse and really dont know what to do about this did think of going to talk to an accountant for help what would you advise.

    I would recommend that you contact our client support team as they will need to look at your full circumstances.
    They will do a review of your situation, and update your budget and your DMP payment if necessary.

    It should say on the original agreement you signed when you bought the car.
    If you cannot find the original agreement,then you could contact the garage the car was purchased from and ask them.

    Hello, this is my first post on the site as I have a problem which requires a level of expertise that is above my abilities. I have managed to succesfully navigate my way out of in excess of £40k unsecured debt and find myself at about £16k remaining. Of this £16k, £9k is interest free £10 pound per month set ups (spread over 4 companies) so this is no problem.

    The problem is the remaining £7k. The problem is that it is rising by the tune of about £30 per month and has been doing for years.

    It is owed to a vulgar company by the name of Link Financial, previously known as asset link.

    Back on the 16- Aug- 2001 I had some double glazed windows fitted, the amount of credit was £3k, a joint financial agreement was entered into by myself and my then wife.

    Within 5 months I lost my job, my wife and I seperated and I got hit with a CCJ as I couldn't pay any of my debts. The CCJ was for £5 per month as I was absolutly broke and on the verge of bancruptcy owing in excess of forty grand.

    I managed to avoid bancrupcy and as previously mentioned, over the next 8 years have really pulled my life together.

    BUT..

    These asset link...sorry link financial people have decided that although I could only afford £5 per month, they would be adding about £35 of interest each and every month between then and now.

    Every so often I have recieved a letter from them entitled 'Statement of notification of interest' in which they remind me that interest continues to accrue on my account in accordance with the terms and conditions of my origional loan agreement regardless of the fact that my account is subject to the terms of a ccj. Also, we would not suspend interest on this type of account. interest will continue to be charged until the debt is paid. However, we will limit our claim to a sum that is lower than the amount we are entitled to claim under the contract, charging the amount that would have been incured if the account had been paid as per the original terms of the agreement on time each and every month.

    I got a statement through the post today showing that I now owe £7361.40.

    My ex wife has never paid a penny towards this joint debt.

    Hi the real eagle and thank you for your message

    The first thing you need to check is whether or not the creditor in question has the right to charge interest. Once a CCJ is granted, the judge will set out whether or not interest can be added on what is owed. This is outlined in the 'particulars of claim' part of the paperwork you would have received. If there is nothing to suggest interest can be added, the added interest on top of the original amount set out on the CCJ is not allowed, and you should question this with the court.
    If the interest was included as part of the claim, you really need to go back to court to have the situation reassessed. If the amount you pay each month doesn't cover the interest, it's never going to allow you to clear the debt unless you overpay. To take the case back to court you'll need to obtain an N244 form from your local county court, or online here and request a hearing. I'd suggest you put your case across to the judge to request freezing of any further interest, as clearly the current arrangement gives you no possibility of paying the debt off.

    Hi can you give me some advise please, I recently took the first step in contacting you a CCCS and you have just today set me up a DMP, debts circ £37k, WOW... Just as this happened I have been offered VR the sum of money on the table would far exceed the amount of debt involved, so its seems to us like a lifeline, what is the best way to proceed now, should we simply pay the lot off, or should we hold on to it a while, in case a job does not come as quickly as we hope? This feels like a lifeline, the decision's we make are not easy though and I need to sence check?

    The redundancy money should primarily be used to fund your priority living expenses until you get a job, otherwise you will be left with nothing to live on.
    Once you have a job and you have a regular income, then any surplus money can be used towards clearing your debts.

    Great to hear your DMP is up and running!

    A CCJ or county court judgement is the term for a judgement made against a person for defaulting on a debt.
    You would need to have been sent a default notice before a CCJ claim form could be issued.
    If you did not miss a payment before setting up your plan, then I presume you will not have received a default notice yet.

    I am not able to predict whether you will receive any CCJ’s in the future as it would depend on the creditor.
    If your budget is realistic and you do not miss any payments, then it is less likely, but unfortunately, there are no guarantees.

    when filling in the debt remedy plan on cccs, is it household income or just income in your name?

    When looking at income and expenditure,it is better to use the whole of the household income and expenditure to give a true idea of any surplus left over after paying all priorities.
    You can fill in the budget using your own income only, but you need to make sure you only include your own expenditure.
