You could pay your all the debt out of this lump sum as this will also clear all the interest that you are incurring, and you would have a fresh start.
You could also ring and ask for a settlement figure. This is usually lower than the outstanding amount.
This will also free up the monthly payment you were making towards your debt, so you would have more surplus in your budget.

Taking out further debt to pay off existing debt is not always a good idea, as you could end up worse off after adding on the extra interest.
If you are struggling to keep up with your priority payments by making the minimum payments then you could make an appointment to speak to one of our debt counsellors about your situation.
The counsellor will put together a budget showing your income and expenditure and then discuss options available for your situation.
To book an appointment with one of our trained counsellors you would need to contact our helpline free on 0800 138 1111. Lines are open Monday to Friday 08:00-20:00. It would be helpful that when you call you have details ready regarding your income, expenditure and creditors, as this can help speed up the referral process. If you have this information ready it may be possible to refer you directly to a counsellor if one is available, otherwise we will arrange a time that is convenient for you to be called back for an appointment.

Hi can you give me some advise please, I recently took the first step in contacting you a CCCS and you have just today set me up a DMP, debts circ £37k, WOW... Just as this happened I have been offered VR the sum of money on the table would far exceed the amount of debt involved, so its seems to us like a lifeline, what is the best way to proceed now, should we simply pay the lot off, or should we hold on to it a while, in case a job does not come as quickly as we hope? This feels like a lifeline, the decision's we make are not easy though and I need to sence check?0

This is my first post and some questions may have already been answered.
My wife has received a letter today from a debt collection agency who are apparantly representing Orange. They say she owes over £200 but my wife has never had a phone with Orange. We moved house on 1st October last year and I have just been round to our old flat and found 3 letters relating to the same debt, the first dated 28th October 2008.
We intend to write to the Debt collectors to ask for details of the debt and I understand this type of letter is called a subject access request.
Can anyone confirm that this is the correct first step in challenging the validity of this debt.
Does anyone have any other advice about dealing with these types of letters?

It is up to the creditor to prove that you owe the debt.
I have attached a sample letter you can use.

Please will you send me a true copy of the original signed agreement together with an up to date statement of the account showing all transactions, including interest and charges, and a copy of any other document referred to in the agreement.
I understand I am entitled to this information under ss77-79 of The Consumer Credit Act (CCA) 1974.
I also understand that this information should be sent to me within 12 working days of you receiving this letter. The CCA states that creditors are unable to enforce an agreement until this request is complied with.
I am enclosing the £1:00 fee, payable under the Consumer Credit Act 1974, for each account.

I am not sure how successful you will be in removing your name from the loan. Banks rarely do this, and would probably advise your ex to apply for another loan to pay out the first. As he is unemployed this is not likely to happen now but may be something that you want to consider when he is working again.
If your ex defaults on the loan, the only thing that you will be able to do is to make an offer of payment to them that you can afford. Hopefully it will only be temporary and the loan company will give you some time to pay. Unfortunately, there is not a lot that you can do until he actually defaults on the loan.

Hi CCCS
Just started my DMP with the CCCS and have paid my first payment today :-) Debt free life here I come!
My Question relates to CCJ's and am I going to get any? I have never missed a payment before entering the DMP due to massive OT that has now been removed (credit crunch bites again) In your experience is it common practice for the creditors to chase a CCJ in the 'start-up' period before they all accept the DMP payment?

The creditor would not be able to send a bailiff as the only person that can do this is the court. I would recommend that you keep sending the letters back and write a letter of complaint and see if that makes a difference.
