  • Hi there,
    I recently received a letter from abbey national saying they've sold my debt on to a third party - capquest debt recovery. This company have now written requesting I contact them to pay a reduced settlement. The thing is I have not heard from Abbey National for almost 10 years and now they say I owe them money.
    Can you help? I wouldn't know if I owed them or not as I have not used Abbey National for many years. Can they still chase a debt after no contact for such a long time?
    Any help appreciated.

  • I work in floating support and often help people resolve their debt problems. My parents asked me to help them with their debt issues. My only experience is with helping people on benefits and my parents are homeowners paying several mortgages and endowments on their home.

    So I really need professional advice.

    I completed an income expenditure budgeting exercise with them, after all necessary expenditures, they are left with £100 expendable income. They have £12000 of debt on credit cards and loans with I did not account for in this exercise, one card payment alone is £100 per month. All card/ loan payments together come to £600 a month.

    I advised my Dad to cancel all the card/ loan direct debits, if these come out next month they will most certainly go over their £700 overdraft limit. He is reluctant to do this.

    I fear my Dad is mentally unwell, he's a very anxious person with obsessions over money and cards, and took many of these cards out, to withdraw cash to put in the bank account to prevent it becoming overdrawn. My Mum has only just found out about these cards this week, and their 32 year marriage is on the rocks.

    I have advised they call the CCCS or CAB today.

    I did not want to advise them any further as I do not want them to lose their home, I know they could offer the creditors minimum payments, and could support them with this, but if those payments were refused, could bankruptcy be requested by the companies, as they have assets?

    Can anyone please tell me how the 28 days period works in clearing a ccj is this 28 days from 1st set of forms issued from the court?
  • I have recently sent in my budget form to the national debt line also sent hold letters and token payments to my creditors but not sure where i stand now as to creditors asking for something payment wise to cover until the dmp is set up
  • Hi Wendy, Just to ask, in anticipation of my applying for a trust deed in the very near future I applied over the telephone to the Cooperative Bank for a Cashminder account. That was on Wednesday. She never said whether or not my application was accepted but I was told I would hear from them in a few days. I still haven't heard as of today and my heart's sinking fast. Any ideas what to do?

    Also, can you advise me if I'm being correctly advised by my local CAB? I asked whether I could be considered for a the debt arrangement scheme but was refused because I am not a house owner. Is that correct? I have around £200-£250 a month I could pay towards this.

    I'd be so grateful for your advice.

    Hiya,

    Been on DMP with the CCCS for few months now. DMP is joint with my wife. Thought things were going well most creditors have accepted plan and interest froze etc. Wife had letter from A&L re her loan which is part of the DMP.

    It is a default leter what worried me though was that the balance on the account showed as more than the balance when we started on our DMP. What has happened to the over £600 A&L have had as part of our DMP. Thought we were dealing with things in right way am not totally peed off am thinking of asking A&L for a CCA request and also the 2 MBNA cc my wife has (also part of DMP) these 3 make up about £15k of our debts all were pre 2007 so think we might have a case would serve bloody A&L right!!!!

    Any thoughs/help?

    Hope you can advise me. I keep receiving mail for my son re: outstanding loan and mobile phone bill. He has used my address but doesn't live here! He refuses to speak to me and I'm not really sure where he's living. I have a mobile number for him but he doesn't answer because he doesn't want to speak to me or face up to his debts. I have phoned the debt collection companies and explained the situation, and given them his mobile no!
    Is there any way of finding out where he is...the police rang me to speak to him the other day. Would they be able to give me an address if they'd found him? Also I'm worried that his bad debts being registered to my address will affect my credit rating. Can you tell me if this is the case.

    I've filled in a debt remedy online and have all the paperwork for a DMP form CCCS ready to send off to my creditors and I have several questions I'd like some help with.

    1. If a creditor doesn't accept the DMP and they start 'proceedings' am I able to come out of the DMP and revert to paying them - I know this sounds a little silly seeing as we wouldn't be in the DMP if we could afford to pay but I'm just trying to offer some assurances to my wife who is scared to bits that we'll loose the home.

    2. I received my paperwork just over a week ago but have had to open a new bank account as my current bank account is also a creditor. Can I send my creditors the CCCS notificaiton of DMP letter (except the bank!) to let them know what's going on and then once I get the bank account details (should be any day) I can sort out my direct debits and where I'm paid and then inform the bank - what I'm asking is do I need to inform them all at the same time from a legal standpoint?

    3. What with Christmas just around the corner I tend to get January's pay before christmas. I have a lot of extra bills coming out aswell and this will make things even more confusing for starting a DMP. Can I stop my direct debits with my creditors (except the bank cause it's still my current account) for the month of December and inform them that I will commence my DMP with CCCS from January 1st? I realise this will mean that I don't pay them anything in December but tbh I have NEVER missed a single payment in over 5 years so far so I'm hoping this will be ok?

    Sorry for the long-winded questions. I know this would be better discussed over the phone and I'll try and ring at some point but due to my working hours it's not always possible :(

    Hi there,

    If your bank account is causing you problems then you could look at changing your ban account to a bank that you do not owe any money at all. This will ensure that when you do get paid, your income goes where you want. Once you have changed your account then you make an affordable offer of repayment to your account.

    A DMP (Debt Management Plan) is a long term reduction in payment to your creditors. The main reason for starting a DMP is that your monthly repayments to unsecured credit are unaffordable.

    You have done the right thing by letting your creditors know what is happening. Even if they are not over the moon with what is happening to you financially – you don’t really have much option.

    Start by getting your bank account on the right track. If you need any help or budgeting advice feel free to either use our online debt advice facility called Debt Remedy, or contact out helpline on 0800 138 1111.
