    I work in floating support and often help people resolve their debt problems. My parents asked me to help them with their debt issues. My only experience is with helping people on benefits and my parents are homeowners paying several mortgages and endowments on their home.

    So I really need professional advice.

    I completed an income expenditure budgeting exercise with them, after all necessary expenditures, they are left with £100 expendable income. They have £12000 of debt on credit cards and loans with I did not account for in this exercise, one card payment alone is £100 per month. All card/ loan payments together come to £600 a month.

    I advised my Dad to cancel all the card/ loan direct debits, if these come out next month they will most certainly go over their £700 overdraft limit. He is reluctant to do this.

    I fear my Dad is mentally unwell, he's a very anxious person with obsessions over money and cards, and took many of these cards out, to withdraw cash to put in the bank account to prevent it becoming overdrawn. My Mum has only just found out about these cards this week, and their 32 year marriage is on the rocks.

    I have advised they call the CCCS or CAB today.

    I did not want to advise them any further as I do not want them to lose their home, I know they could offer the creditors minimum payments, and could support them with this, but if those payments were refused, could bankruptcy be requested by the companies, as they have assets?

    Your dad does need to cancel his card and loan direct debits. He also needs to change to a basic bank account elsewhere if he has debts and overdrafts with the bank.
    He should then put together a budget showing his income and expenditure.
    Whatever is left is the realistic amount he can afford to offer to pay his non priority debts.
    His priority debts such as mortgage/council tax/utility bills all need to be paid first.
    If they would like to speak to a debt counsellor about their situation, they can call for an appointment free on 0800 138 1111. Lines are open from 08.00 until 20.00. Monday to Friday.
    The counsellor will put together a budget with them and then advise them on the options available for their situation.
    If you would like to do this on their behalf, then this is fine, as long as we have written authorisation. Just explain when you ring for the appointment.

    If the CCJ is fully repaid within one calendar month from the date of the judgement, it will be removed from the register and credit reference agency files.

    After one calendar month, the file will be amended to show satisfied,but it will stay on the credit reference file for 6 years from date of judgement.

    A token payment should be fine until your plan is set up. Just let them know when your plan is due to start and do not be pressured into paying more than you can afford.

    I've spent ages lurking round here and have finally decided to bite the bullet and go with a DMP with CCCS.

    I received my letter from them today and with this there's the form to copy and send to creditors, do I send my token payments with this or does that come later?

    Also despite reading almost everything on here I'm still feeling nervous, what if the creditors don't agree - the largest creditor I have is Halifax (around £13k), whats the worst that could happen??

    Hi dandydingo and thank you for your message

    As far as I am aware, you do not need to be a home owner to do a DAS.
    I would recommend that you call us for an appointment to speak to one of our debt counsellors about your situation. The counsellor will look at all the options available for your situation, and if a DAS is an option,will give you further help and advise.
    With regard to the bank account,it can take a while to hear,but if you still haven't heard by now,you could contact them to see what is happening. The counsellor can give you further help with applying for an account.

  • According to my credit report, I have a CCJ against me in 2006.
    I was out of work during this time, and when I started working towards the end of 2006 my firm recieved a letter for an attachment of earnings. I know my employers filled in the necessary information, but I haven't heard anything since, nor has any money been deducted from my pay.

    I am now in a position to start clearing this debt, how do I go about it? how do I find it again?

  • Hi there, hope someone can shed some light on this one.

    Okay here's the scenario, I...
    • ..now have around £6,500 of debt with 4/5 different companies (reduced from £16,5000 with help from the wonderful CCCS).
    • ..have an Experian 'account' and at present have FIVE defaults (of which I still owe money to FOUR).
    • ..as recently as the middle of this year, moved address and have only moved over my 'good' debt e.g. mobile phone, credit card, bank account details/overdraft (never really use) etc.
    And now here's the puzzling bit, having recently logging in to my Experian 'account', purchasing the credit score feature and finding myself rated over 950!!! and with 6 different credit lines all with green 0's (payments all made on time and in good standing) :T I'm super confused?!?! Obviously, my previous debt isn't wiped out and I am continuing to make good with payments via CCCS and the bad creditors still have my old address (family) details. What's the situation? only I remember seeing something similar in another forum about waiting three years then you're all good!?!?

    Any help would be much'os appreciated!
  • Capital Debt Recovery (.co.uk) say they could wipe clean my credit card because it was illegal for the banks to raise the limit without me signing a new agreement.

    I would pay them quite a big fee - but it comes out of the credit card which will then be wiped so would effectively be free - but even if I paid the cost upfront it would still be much cheaper than paying back all the debt on this card plus the interest.

    It all seems to good to be true. Is it or not?!

    I could post more of my own details but right now I really just want to know if this is a known scam, or a loophole that is known to work.

    Hi there,

    Thank you for your post.

    As you are aware there is no guarantee the creditor to stop interest when you are on a DMP. Have you asked A&L if they have stopped the interest? You could try and request a statement so that you can see exactly how they arrived at the balance.

    What will probably happen now is that you will, in the near future, receive a letter from a Debt Collection Agent (DCA) advising you that they are collecting on behalf of A&L. If this happens make sure that you advise us so that we can send out a proposal to them with your budget and offer of payment. The interest usually stops when this happens.

    If you have any questions regarding any debt on your DMP you could contact our client support line (number is on your statement), and they will look into the charges and whether the interest has stopped.

    Hi aliadds,

    The only thing that I can advise is that you send the post back, this should ensure that you do not receive any further correspondence.

    A credit history is an individual thing, so as long as you do not have a financial link (joint account, etc) with your son then his history should not affect you. If you want to get a copy of your credit history, I have attached a booklet that will give you information on how to do this.
