  • Hi -after reading your post today, if you can't negotiate affordable payments for yourselves, I would suggest ringing CCCS, (number on internet) and asking them to make you an appointment with a debt counsellor. You should not have to split up, ie partner move out. You need to stay put as a family, and afford priority debts ie rent, utilities food first. Debt always comes second. I realise you might be trying to avoid any negative info on your credit file, but I think if handled properly with CCCS, it might be possible to avoid this and have more affordable repayments, over a longer term. So, ring them. I did, some years ago and they took all my stress away. Good luck.

    Hi,
    I have had arrangments with several debtors (some via debt collection agencies) for several years now. I recently asked for my credit report to see how things stood and am somewhat confused by the outstanding balances that show on some accounts. Some are a lot more than I expected and some a lot less. I want to ask for a statement of all my payments over the past few years to see if everthing is being credited properly but I am not sure whether to contact the company that the debt was originally with or the DCA. Can anyone advise the best course of action and maybe point me in the direction of a template I can use? Do I have to request under specific legislation? I am also thinking of making an offer of a reduced final payment on a couple of them using xmas money to get them out of the way. Any idea of where is a good place to start i.e. 50% or 75% of the remaining balance.

    Any help gratefully recieved.

  • Hi, is there a template of a letter I could send for payment towards a Final Charging Order? They say "Where no payments are being received in reduction of your liability to our client it is our client's policy to proceed to apply for an Order for Sale". (This isn't my debt it's my parents, I don't want to see the house go and thought if they offered a minimum, affordable amount (my dad has health problems and is self employed) this would help?!

  • Hi there,new to this and about time I got my head out the sand.Quick summary lost job end of March always struggled to pay debts off but coped ok.Used to earn good money 60k ish and life style to suit and yes every month money was all gone.I have fallen behind with debts and after a short period of umemployment started part time work in September not much money but some.I used some redunancy money to retrain and do a 8 week intensive electrical course.Registered as a self employed sparky now to help with income.We are up to date with morgage no arrears at all and council tax.Have paid off 2 credit card almost 11k and now no money left ,its all gone.
    I have a large debt owing to bank and a loan (18k) and now they are doing a CCJ end of November.I have proposed that I do £40.00 a month initially to at least pay something and the latter payments be increased to make up for the initial low start,they are not interested and now they say they want a lump sum suddingley.I am maxed out on overdraft £3.5k.My next move is to do a revised budgets and send to the courts,I admit to whats owed but the solicitors changing tactics now and asking for a lump sum is a bit strange,or is it ?.A earlier telephone conversation with them they said I could do installments over 5 years.Other debts owed with other lenders have accepted token payments and frozen interest.One lender took payment of £3.3 against a debt of £4.4k so it was worth paying off.It was so easy to get credit and amounts on cards kept growing with no ceiling being applied and ever increasing credit limits to match increased spending.I know I have been stupid but while debts were managed it was sort of ok but now the brown stuff is really flying and I am finding it difficult to think about anything else,family and friends are suffering.

    Have an urgent question. In August I agreed to pay £11.28 off a debt every 2 weeks, ok so I only made 1 payment (Wont go into details here for the mo as complicated).
    The arrangement was that I had to pay a minimum of £11.28 there & then on my debit card to avoid further action (Court) & call back every 2 weeks to do the same, despite being on benefits & having other debts.
    So I made the first payment & no more, I have recently set up a direct debit to make payments that I can just about afford but the debt company took 2 payments of £11.28 the day I deposited the money to cover the DD, which is now in the process of bouncing.
    Is this legal? because if it is I will end up with another larger debt & I have more than enough problems as it is.

    Hi,

    I have read alot of website where you can have the debt on your credit card wiped off if it was taken out before 2007?

    I have had my credit card with MBNA for over 5 years (cant remember exactly when i got the credit card and i cant find my agreement anywhere)

    I currenty have a debt of just over £5k on the card, is this something i could challenge with my credit card company to have it wiped off as i have had the credit card since before 2007?

    BUT the amount on the credit card was transferred from another debt last year? Therefore this credit card has had a zero balance since i got it? does that matter?

    I am trying to pay off my debts but starting to find it a bit hard, as i also have other debts which amount to £36k and it would be helpfull if i could get rid of the credit card.

    My other debt is 3 x £10k Loans and Car Loan for £6k, my monthly repayments at the moment (without the credit card debt, loans only) is £720!

    I am still managing to pay everything but starting to struggle a little now, is there anything i can do? Also i have a mortgage so bit worried about started any debt recovery as i do not want to lose my house.

    Hi I wonder if you could offer some advice for me and my partner its his financial problem,he has a loan with Nationwide and only has 10 months left to pay for a £10,000 loan over 5 years,this past year the bank have somehow managed to mess up his payments and to rectify their mistakes we made a new agreement with them to take the original payment and £50 extra a month,taking the amount to £285 a month,they managed to take only the £50 and not the loan amount putting us further in arrears(prior to this there were no missed payments etc),after more phonecalls and complaints,they have admitted liability but it doesn't help our financial position,whilst they want him to carry on paying the £285,they are reducing his overdraft by £50 a month ,it was originally set at £700,so far its been reduced by £50,we exist partly on his overdraft,we just don't know what to do,we have tried to get a new loan and were turned down,we have asked to borrow money but to no avail,we rent our property and have 2 children,at the moment we just don't know what we are going to do to get out of this situation,we need to find a solution or he will have to move out and I would have to go onto benefit.Can you please offer us some advice as we don't want our family to break up.I am so angry with the bank for putting us in this position and only giving us £200 compensation for their mistake,we are at our wits end,also they have charged him for return of Direct debit payments,because they continue to take payments for the loan on a different day then what was set up,the money isn't there because of when my partner gets paid....they know this yet still take the payment and then charge us for it.

    Hi there.

    It's quite hard to discuss your options without being able to see all of your figures in front of me. I think your best bet is to give us a call so we can book you an appointment so a counsellor can spend time on discussing things with you in detail and hopefully get things back on track.

    You certainly don't need to consider moving out and splitting the family up to sort this.

    When you get a minute, call the helpline on 0800 138 1111 to get the ball rolling, I'm sure we'll be able to help advise further.

    Hi Lou.

    If you want to get confirmation of what has been paid over time time you've been making the payments you need to ask for a 'data subject access request'. Basically you're asking under the data protection act all of the information they hold on you, including payments made etc. I would be inclined to send this to the debt collection companies you've been sending the payments to. The following link should be of use, and also contains a template letter:

    If you consider making an offer of settlement, there are no rules to say where you should start. Your best to start low and work your way up, so perhaps start at 30% and take it from there. You might find they accept a lower amount than you thought!

    We don't have a template letter of this sort I'm afraid.

    Can I ask a little more about the charging order? Has the final charging order been set by court yet, and was an instalment order agreed as part of the charging order by the judge?
