Hello, I am waiting for my pack from CCCS to start a DMP. There were a couple of questions I forgot to ask.
1 - What happens if one of my creditors refuses to agree to the DMP. Lloyds TSB credit card is my biggest creditor. Will they take me to court or sell the debt to a DCA. Are they likely to agree to the DMP with CCCS. Saying I have not been their best customer is an understatement. I have not paid anythi9ng for a year on my credit card. I wrote to them recently and sent a token payment, will me not paying sway the decision.
2 - If the creditors dont freeze interest what happens? I take it it will just take me x amount of years longer to pay.

3 - I am up to the limit on my agreed overdrafts. I still cant get my head round this one. I currently pay Lloyds £40 approx overdraft charges and Nat West £10 approx together with their advantage gold account charge of £12.95. I have just opended another account with Halifax and no further wages/dd's will be paid in or out of the 2 mentioned accounts. So if they refuse to stop the overdraft charges what happens, obviously there wont be any money in the account and the accounts are up to their limit so will they just increase the overdrafts? Also can they demand I pay these back even if I am on a DMP and if that is the case what happens then?

If a creditor does not accept the offer, the key is just to send them the payments anyway. If you have not been making payments in the past, then by you approaching the CCCS for advice and going on a DMP they can see that you are trying to sort things out.

We would just send the payments anyway. It generally takes a couple of months for the creditors to stop the interest and charges; however as a DMP is an informal agreement they are under no obligation to do this.

This is why we recommend that you open another bank somewhere else so if they do go to take the money the money in your account is safe. Your overdraft should be included in your DMP so it will get a payment every month. I would recommend that you cancel the £12.95 charge for the account.

Have you ever had cases before where a creditor has refused a DMP from the CCCS? I wondered what would happen then to the debt. Thanks:idea: LBM 23-10-2009 - Total unsecured debt £39,638.65 _pale_

Need advice pls i was advised by the cccs to make token payments after losing my job and to open a basic bank account. I have opened i barclays one. One of my main debtors is Barclaycard. Should i open another baisc account with a different bank??0

hi, I currently have a debt management plan however i am a partner (50%) in a company which has been hit by recession and is now £100,000 in debt. Due to company set up costs i am also in about £25,000 worth of personal debt. Would bankruptcy be the option now? I have no assets only a very old car, no property or savings. My share of the debts in total account for £75,000 but I have no income from the company (i have never worked for it, my husband does and he's not received much in wages for the past year). The other partner is not my husband but a friend. I know I am responsible individually and wholly for the company debt. Any advice would be most welcome???0

Thanks for this. I am similar problems with M&S money calling me at work and leaving numerous messages with our receptionist who is getting annoyed by this as I shouldn't accept personal calls at work. I have never given them my work number so can't work out where they have got the number from. They have my direct line and the main office number. I have told them verbally 3 times that they need to write to me but they have then got very aggresive and I have had to end up putting the phone down on them. I will be sending a letter as below to them by recorded delivery tomorrow and I have just e-mailed them a copy as well. Is there anything that I can do?

Hi, hopefully some one will be able to advise me on this. I moved in to my apartment 12months ago and get mail every other day for the previous tenant. I was just putting it back in the post box with and RTS message on it but the letters keep on coming. Today I decided to open them and was shocked that there were 2 arrears notices for £3k loans from different companies. I rang both of them and advised that the person had not lived in my apartment for over 12months and one of them asked if I had received anything from a company called Connaught which I can only assume is a debt consolidator of some sorts. Now I am worried as the 2 loans on there own amount to £6k of debt registered to my property and I am concerned that there may be more. I have alway had a good credit rating but recently I have had inccidents where credit card companies have reduced my credit limit considerably saying it was down to "responsible lending" even though I always pay my bill in full and on time each month. Could this persons debts have anything to do with this and if so how do I rectify the problem? On a recent credit check my credit rating has gone from excellent to fair, although I have never defaulted on any payments or racked up large amounts of debt. I am really worried that this other person is affecting my credit status and it may prevent me from getting a mortgage or credit in the future.
Please can some one give me some advice on what to do?

Try not to worry, credit files are against the individuals name not the property. I would recommend that you keep popping the letters back in the post to the creditors.
Connaught are a collection agency so the will be collecting the debt on behalf of the original creditor.

I have a big question, we have been on a DMP with payplan for 18 months now and it is failing miserably added to the fact I have just lost my job, my house is in negative equity and is getting repossessed next month. While the lady at payplan was lovely she didn't seem to be able to offer any advice she told me to fight for the house even though the mortgage payments are far to high, she seemed to be more concerned with getting there partner company to offer us cheaper insurance when I have allready got the cheapest possible on everything! We are in a minus surplus at the moment with the mortgage but if we rented and didn't have any debts we would be able to survive, should we go bankrupt?

I would not be able to say if bankruptcy is your best option as I don’t know your full situation. You would be more than welcome to have an appointment for the CCCS to look at your budget and make suggestions. Are you still in the mortgaged house?
