Oh - we have a debt with Abbey and our DS2's CTF is with Abbey as well. They can't take that can they?? If so, please let me know and I'll do whatever I can to change it as soon as possible.

Also, all the bills are in DH's name, except for our overdraft which is on our joint account. I pretty much figured once we send them the "token payment" letter from DH, that they are going to contact me to come after me for the overdraft as I am listed on the account as well. Can I simply tell them that I will only be able to make small payments (I am a SAHM) each month, and how much of the balance am I responsible for? all of it? Or can they not come after me if DH is making payments (albeit small ones) on it. This is the only account that I am on. (And obviously why I am concerned over DS2's CTF, as although it is in his name, my name is on it as his parent)

    Dear CCCS counsellors

I have today been told that some of us will lose our jobs by the end of the year (Xmas not financial year).

My review is coming up ... should I let CCCS know now that this has happened?

Also, what will happen if the worst comes to pass and I'm one of the 'victims'. Assuming I would not get a job straight away and that without my salary our payment to CCCS would not be affordable ... do we get chucked off the plan?

    Many thanks in advance

Hello, I am waiting for my pack from CCCS to start a DMP. There were a couple of questions I forgot to ask.

1 - What happens if one of my creditors refuses to agree to the DMP. Lloyds TSB credit card is my biggest creditor. Will they take me to court or sell the debt to a DCA. Are they likely to agree to the DMP with CCCS. Saying I have not been their best customer is an understatement. I have not paid anythi9ng for a year on my credit card. I wrote to them recently and sent a token payment, will me not paying sway the decision.

2 - If the creditors dont freeze interest what happens? I take it it will just take me x amount of years longer to pay.

    Sorry I rmembered another one

3 - I am up to the limit on my agreed overdrafts. I still cant get my head round this one. I currently pay Lloyds £40 approx overdraft charges and Nat West £10 approx together with their advantage gold account charge of £12.95. I have just opended another account with Halifax and no further wages/dd's will be paid in or out of the 2 mentioned accounts. So if they refuse to stop the overdraft charges what happens, obviously there wont be any money in the account and the accounts are up to their limit so will they just increase the overdrafts? Also can they demand I pay these back even if I am on a DMP and if that is the case what happens then?

Sorry for all the questions. Many thanks

Very similar to us Triggles, one of the counsellors will be here soon to help us Im sure. Very worrying isnt it. So much to think about.
Abbey have just told us they are withdrawing our overdraft on the 1st Dec so they are included as one of our creditors now which prompted me to open a new joint account elsewhere and shift the priority direct debits over, still working on that now. Then that got me thinking about my girls' accounts and the child trust fund with Abbey. :(
I am ready to hear the advice so can act on it asap.
Oh my days, we are going to feel a whole lot better when this gets sorted! Looking forward to the day when things calm down a bit!

Hi christr11 and thank you for your message

You can only pay them what is affordable, so you need to put together a budget showing your income and expenditure. This will show how much you have left to offer after paying all your priority bills.
If there is no surplus, then you should offer a token payment of £1 until your circumstances improve. Do not be pressured into paying more than you can afford.
If you would like help to put together a budget, and you would like to discuss your situation with one of our debt counsellors, you can call for an appointment free on 0800 138 1111.
Lines are open Monday to Friday 08:00-20:00. It would be helpful that when you call you have details ready regarding your income, expenditure and creditors, as this can help speed up the referral process. If you have this information ready it may be possible to refer you directly to a counsellor if one is available, otherwise we will arrange a time that is convenient for you to be called back for an appointment.
    Regards
    Sue

    Hi

Santander have finally replied to my letters of July, August and September stating that they won't help as I have not provided relevant proof.

They want me to send my bank statement, details of income, utility bills and details of all other creditors. Can they do this?

If I just ignore this and continue to make my reduced payments, what would happen?

Hi Imclean100 and thank you for your message

I would recommend that you send them a copy of your budget showing your income and expenditure so that they can see how much you realistically have left after paying all your priority bills and a list of all other creditors to show them who else you owe money to, but you do not have to send them copies of your bank statements.
Your budget will back up what you can afford.
If you need any assistance putting your budget together, you can ring for an appointment to speak to one of our debt counsellors.

    Regards
    Sue

I need help with a couple of things. I spoke to CCCS a few months back, and have taken their advice to date. I have managed to pay a few debts off outright with a mixture of some bank charges reclaimed, and also by directing my spare cash to my prioriy debts. I still have some debts left, but things have changed, my income has gone down further (I am self employed), and the debts I have are mainly non priority. The only two priority debts outstanding are this years council tax, which I am 3 months behind with, and last years water bill.
My question is, do I contact CCCS again to revisit these debts?
Also I had a call from a company, I don't know where they got my number from, telling me that there was no choice but to go down the IVA route, which obviously they could set up for me. I told them I was not interested, despite this guys insistance that there was no other option for me. He even put it to me that he was offering me a service (yeah right!), and that mortgage and credit/loan companies are looking back up to 10 years on you credit file, before giving credit. Well I am struggling to pay my debts off, so I'm pretty certain that even a blind man would give me credit right now, not that I want it. I am very concerned that these companies are allowed to operate like this. Are they??

Hi Bekki0405 and thank you for your message

You should be extremely wary of any one calling out of the blue, offering to set up an IVA for you without knowing any details about your situation.
An IVA is a legally binding contract and is not always the best option for everyone.
If your circumstances have changed and you would like to discuss your options again with one of our counsellors, then please ring our free helpline number to make an appointment.
You need to concentrate on clearing the priority debts first, so the council tax and water bill have priority over any credit cards/ unsecured loans etc.
Once these have been cleared, then you can work on paying off the non priority debts.
    Regards
    Sue
