Hi,
If you could be kind enough to answer my question it would be much appreciatted. My husband was a part owner of a small ltd company that went bankrupt last year. He had taken out an MBNA credit card which although was in the company name he seems to think it was a personal credit card agreement. MBNA's solicitors have now issued a CCJ against us but just wanted to know if as it was used for a business that has now gone bust are we still liable for the debt.
My husband subsequently found a job as an employee but then was made redundant and is now on jobseekers allowance. We have taken advice and are making token payments to the companies we owe money to. However, I just suddenly thought as this credit card was connected with his old business should it be treated any differently to our other credit card debt????

Thank you for your message.
If the debt is a personal debt or your husband signed as a guarantor then he would be liable for the debt. He will need to complete the forms and send them back as soon as possible with an offer of repayment (that’s if he is admitting the debt).
As your husband is on benefits then he could just offer £1pcm if that’s all his budget supports. He should not feel pressured into paying more than he can afford.

DMP’s always start on the first of the month, so it’s unlikely that the plan will start on the 1st November I assume it will be the 1st of December. If that is the case you will need to just make your creditors a token payment for November just until the plan is up and running. You will receive your welcome pack soon after we receive the information back from yourself.
I would say give the CCCS a call though because if you have all your information then you maybe able to start from November.

Thanks, I was really hoping to get it set up to start on November 1st. Have just posted back all the paperwork now so hopefully I will get my welcome pack and start date before the post goes on strike. I imagine even my token payments will have trouble going through then, and that's maybe next weekI'm 26, been with my OH for 8 years - we have 3 beautiful daughters and no debt collector can ever touch our family.LBM: 03/10/09 Unsecured Debts: 69K :eek: DMP Start Date 01/11/2009.0 -

Just a quick queerie - we owe a few cc and are paying them nominal fees - which most accept and the others do but carry on writing and ringing anway from time to time - AND also send regular statements showing 0% interest added
except ONE - C L LEWIS who have taken over 3 of our accounts from other sources, so we owe them a third of all our debts (9k ) but havnt heard from them ( statements or phone calls ) for months - even though we are paying nominal amounts for the 3 accounts they hold ............. should I be worried they are up to something ? - as I say the other creditors send statements and worry letters on a regular basis - but not them !?As Martin says - please be nice - there is no such thing as a stupid question !0 -

He couldn't afford to pay them back , so we did ask for them to lower the monthly payments But it did get too much and we hve stopped paying them. My boyfriend doesn't do the course anymore and advent haven't been in touch. We also took out two smaller loans with my bank lloydstsb. But with everyday living and bills on top, everything sems to much. My boyfriend has spoke n to trapped.co.uk......
ANY advice / help please?

I wouldn’t worry too much about this, debts tend to go in cycles i.e. the debt will be passed to one company and they will try and work the account, then it may get passed back to the original creditor then somewhere else. As long as you are paying what you can afford you will be fine.
