    I have just completed my CCCS online deby remedy. It has suggested a low start DMP which i have started the ball rolling with and sent for my welcome pack etc.

    My current situation is due to my patner leaving me for someone else three months ago. We signed up to a new 12 month tenancy agreement in January for £500 a month which we didn't feel was excessive as there were two incomes coming in so in effect it was £250 pcm each. The council tax is a band B so again not too excessive. The problem is my ex partner has had serious debt problems in the past so the tenancy was taken soley in my name, now my partner has left me i am footing all the bills for the property on my own and it has become nearly impossible. I have always had quite a high level of debt myself but it has never been impossible for me to deal with, obviously now i cant manage to meet my day to day expenses along with my debt repayments.
    I have spoken to my landlord who wont release me from the tenancy even though i have expalined the situation and wont reduce the rent. I am tied here until January. In january i will be moving back in with my parents - do you think it would be worth writing to my creditors to explain that in January i am hoping my situation will improve?

    :j OMG I'm pregnant BUT also only 2&half years into my 5 year DMP with CCCS, I started off £35k in debt and now have £18k to go. I'm 2 mths so will only have max 6 pay packets until I go on maternity leave.

    I'm going to let CCCS know on Monday. Currently paying £900 per month into my DMP and obviously will not to be able to pay much into DMP whilst pregant and on maternity allowance.

    Oh god, feel like I'm going backwards BUT saying that both I & OH are very pleased to be having a baby :T

    Can anyone help, OH say he has some money about £5k that we could use to pay off debts do I go thru the CCCS and try a negioiate some final paymets with this??

    Any suggestions & advice would be great! Cheers in advance!

  • I'm in the process of setting up a dmp with cccs and am waiting for my pack to arrive. I have just spoken to the student loans company and they said they will be raising the deferment limit in september which will mean I can defer my repayments.

    I will have a few arrears to clear still but should I still include the whole debt in my DMP or just the arrears? I can still make payments while it's defered, but then again if I didnt (apart from the arrears) then I could put more towards the other debts, at least for a year anyway. Also I'm not sure they would be happy with the arrears being spread over the whole dmp rather than the next few months (or year).
  • I've been looking at DRO vs DMP and I'm wondering if someone can clarify whats included as asset under £300 in a DRO?

    Hi all,
    I am new to this forum and this is my first post. This is an excellent service offered free of cost. First of all I would like to thank the nice people who are helping each other.
    I am in a very dreadful and different situation to others. I would be thankful if someone could read this and advice me.
    With Lloyds TSB- I have 2 loans and a CC.
    1st loan: Issued in 2007 Dec. It was for £18K for 7 years with 9.9% interest. I was also sold PPI of £5.7k with the same interest. I will end up paying £33k in 7 yrs for the original loan amount of £18k. The monthly payment is £400 (with £95 for PPI).
    2nd loan: Issued in 2008 Oct. It was again for £18K for 7 years with 15.5% interest. I was also sold PPI of £6.2k with the same interest. I will end up paying £39k in 7 yrs for the original loan amount of £18k. The monthly payment is £460 (with £119 for PPI).
    Don’t ask me why I have agreed to take with such high interest because I am not aware of PPI and interest rates in and out. Also I was told both the times I will not get the loan if I do not take up PPI. I just thought monthly payments seem to be fine and said without much knowledge.
    After seeing this forum only I came to know that I was missold PPI and my hard earned money was paid for nothing (THANKS TO MARTIN). Also actually many people are in my situation and reclaiming it.
    CC: I have taken my CC in 2004 and got it along with PPI by just ticking a box in the application without actually knowing what it is. I was using it since then and paying both PPI and monthly minimum payments. I realised I was paying too much of PPI per month as my outstanding balance increased and I recently cancelled it in May 2009. Can I reclaim my PPI that I paid from 2004 to May 2009. Can anyone please explain how this works?
    I have never made any late payment and working REALLY hard to keep up to the minimum payments till date. I used to do 2 jobs and all my wages all going for my payments. However now I do not have my second job as it is an agency work and only have one income of £900 pm after tax. It is almost impossible for me to keep up my payments.

    My questions are:
    • I want to claim PPI for both my loans and also for my credit card. Is it possible? I haven’t cancelled my PPI for both my loans so far. Can I cancel it first and then claim for my already paid PPI. If so can you please suggest me how I can do it. (I have gone through the postings in this forum but not entirely sure of how to do it.)
    • Also after many sleepless nights and borrowing from friends to keep up my payments to the banks I am finally thinking to go for DMP. I realised I cannot keep up my payments by looking at my income and expenditure charts. (as I have other CCs as well with an outstanding balance of £8K). So is it possible to reclaim my PPI back, and also go for DMP. If I can do so is there any time limit between these two. Please explain me in detail

  • HI there wonder if you can help a little more.I have a company called Robinson Way chasing me for a debt of which I have no knowledge. I have contacted the Ombudsman about this debt as they have not been able to prove that it is still in existance, as per my previous email all my debts were paid at the end of 2004. They have been unable to provide anything other than a final page of an agreement with what appears to be my signature from 2002 and a screen print which they say is from 2003/4 which does not show any dates. I have written to them as per your advice and said to stop the telephone calls that have started since I involved the FSA which is when they obtained my number from the official complaint and pointed out that it is in dispute and being dealt with by the FSA as a complaint. They are still calling 2 -5 times a day, often automated telephone messages, or just missed calls. I have told the FSA and they are now working on the information that I sent them although both they and I believe the calls should stop. When there is a person they are very aggressive in their manner and have said they dont care that I have involved the FSA and advised not to telephone, that is how they want to collect the debt. They are questioning my son if he answers the phone.How can I stop these calls? I honestly do not believe that I owe them any money and they have been unable to prove otherwise, yet still they are calling. I have made official complaints via the Ombudsman, yet they dont care and are still calling. Can you advise any other method that I can use or body that I can approach to stop these bullyboy scaremongering tactics? I suspect they are no longer writing as it is hard evidence that I can use against them in my complaint and they are unable to prove that the debt if it does exist is not statute barred - they did in one letter say that even if the debt was statute barred it still had existed, which is a little confusing.All help most welcome so that I can answer the phone in safety againThanks for your advice so far,

    I am hoping that one of the CCCS counsellers could give me a bit of advice. I have completed all my paperwork for CCCS and have started telling my creditors that I am enting into a debt mangement plan with CCCS and giving my reference number. I completed the online debt remedy and in the statement of affairs for expenditure, I completed all my costs within the limits that were allowed for 3 adults and one child in the household (it told me if any amount I had entered was too high). Now after reading a couple of posts on here I am concerned that my creditors may come back and challenge these costs. Is this the reason that CCCS have the limits set so that they are less likely to be challenged by creditors. I would appreciate your advice.

    Thank you for your message.

    You could write to your creditors and explain that there are going to be a changes in your circumstances. If you do decide that you are going on a DMP, in January you would just need to let us know the changes in your budget and then we could update this on the system for you. As your deposit will increase this would reduce the term you are paying your debts over.

    Congratulations on your news!

    If you just give us a call and we can talk through your options. I don’t have access to your budget so I don’t know your full situation but if your partner is willing to give you £5000 and you have debts of £18000, you could maybe look at a full and final IVA or full and final settlements. When you call ask the advisor if this is possible on your budget.

    I am on a dmp and pay dd but this month it got returned for lack of funds:o. the thing is it is so hard at the moment as I have a long term severe illness, which obviously means I cant work which is why I started the DMP and my OH was made redundent in april and it has now really hit us.

    I have 3 debts on my dmp,
    One company were taking me to court to get a charging order on the house as they wouldnt accept my dmp as it was because I was ill, and after putting in a defence they have offered to forgo all debt as long as I withdraw my defence, I have this in writing from their solicitors.

    Another company have refused the dmp and are continuing to add £90 interest and a default each month even though they have written to me and said that they have no signed CCA and have admitted that they cant take me to court, so I feel like giving up on this one.

    The final one have accepted the DMP although if the CCCS havent made the payment on time for their records on my statement they add a default charge to it.

    I realy dont know whether to just pay the one that accepted the amount I can pay myself every month so it reaches them on time and obviously as soon as the court have rubber stamped the Tomlin order I can forget one of them, and as for the one with no CCA and that are keeping adding on nearly £100 a month, my £19.00 a month hardly seems to be worth continuing with.

    Any advice greatly recieved
