    Hi KATTY

    The creditors may eventually go for a CCJ, but a court will not make you pay money that you do not have. So if you have been offering a fair amount to any creditor and they go for a CCJ, you can offer the same amount and this is the amount that is likely to be set at per month.

    If they refuse the offer the payments should be kept up, but it is possible that they may add on more charges. But you have to remember that you can’t pay money that you don’t have so making the payments regardless if they refuse will still keep lowering the balances.

  • Hey i'm currently on a DMP with a company and i pay them an additional sum for this as they do the work for me, etc, etc. I would like to go with CCCS on a DMP but i'm worried about changing as i don't want to have letters/phone calls about my debts from creditors from the time i cancel my old DMP and go with my new DMP. Roughly how long will it take set up the new DMP? Also i'm not very orgainsed so would CCCS help towards setting this up and helping me manage this DMP?

    Any infor would be great!

  • Many thanks. Yes, I thought that would be the case. And in fact I would rather do everything together anyway. I'm just worried that the payday loans people won't accept a DMP so that I would have to continue paying them which would leave me in a quandry about how to pay any other creditors who may have been good enough to agree to a plan.

    Can someone give me an idea or where to find an example "acceptable" budget plan for a DMP - i.e. what creditors are likely to accept e.g. for monthly groceries, clothing allowance, travel etc. I have no car or dependants so can be fairly tight about what I allow myself each month for rent, bills, groceries etc. My only real problem is that I travel with work a lot, I claim it all back on expenses afterwards but I'm worried about how that's going to work if my budget is super tight.

    Any advice or links would be great please.

    Hi Samantha

    The time it takes is dependent on when a DMP has been offered to when all the paperwork is returned to allow is to set a plan up. At the moment we are offering plans to start at the beginning of September, but if people cant get all the paperwork to us for before the end of the month the plan may not start until October.

    If you are offered a DMP through an appointment with a counsellor or through our online advice facility called Debt Remedy you could still keep using the other company until you know the plan is set up with us and then cancel your payments to the other company.

    We advise you fully on what you have to do to get the plan set up, and we have support teams available through the entire process to help and provide advice.

    We discuss all your figures and advise on areas you may have to much or not enough in through the appointment. They are only guidelines that we refer to so we do allow flexibility.

    To cover you travel costs you may have to just save up a little emergency pot to use for this before your plan starts, or possibly ask for the company to pay for all your travel directly so you don’t have to pay out yourself.

    Hiya got my review on monday

    few changes wife on maternity tax credits altered i also had a loan for a car that i had paid off then about 2 months ago the car just totally packed up and i rely on this for work the garage said not worth repairing so i had to get a new one my parents loaned me the cash to get a new car and i pay them back monthly how will cccs look at this because i know your not supposed to have any extra borrowing

    also i had a letter from ccccs about 3 weeks ago saying that one of my creditors were not going to collect the debt anymore, cccs didnt say that they had sold it on i havent received any correspondance from company nothing, and this month cccs didnt pay them. Cant understand what that means

  • We are thinking about taking out an IVA, we have a together mortgage with the northern rock. The mortgage and unsecured loan was taken out together and a further secured loan added a year later. We make one payment to Northern rock every month. Would the unsecured loan be included in the IVA or is it classed as part of our mortgage? We have spoken to 2 companies so far and had completely different answers off each. We need to know for definite before we proceed as it will make a massive difference to our IVA.

    Just wondering if CCCS can help me on here

    I am so gutted, was going to do a Debt Relief Order, but just found out that my pension that I started in Jan, is worth £345!!!! I honestly am so upset I don't know what to do with myself.....I just spoke to Barclays on the phone who are SO NASTY it's unbelievable:mad:, and will no accept my payments to them to pay off overdraft, despite me telling them my very difficult and personal circumstances

    Would it be considered fraud to cash in my pension, throw it at my debts and then apply for a DRO? I only started my pension to try and better myself:mad:

    Please write to your MP about the DRO and pension issue.

    Hi,
    I have been on a dmp for the last 2 years, it was going well until had another baby, I stupidly took out payay loans which i can no longer payback, I informed cccs last week who asked me to send them paperwork, im scared i have put my plan at risk
  • My partner and his ex wife split up a year ago. The mortagage hasn't been paid for a year as he had to pay for somewhere else to live. She has now gone to Spain and we want to move into the property. We have got a hearing on Tuesday to see whether the house will be repossessed we have laid put how why we haven't paid it and that we can afford it. The main reason is we are trying to get her off the mortgage as if we start paying it she is still 50/50 tied to the property therefore still has rights to the property. How is the court likey to view this?

    Any Advice greatly appreciated.
