Hello,
I have a DMP with cccs and the outstanding balance is about £2500 (i haven't received statements for a while). I was wondering how full and final settlements work, now that I'm nearing the end-ish. My OH really wants me to get rid of my debts and is willing to help. Would it simply be a case of paying the full £2500 for example, or would the creditors accept less than this?
Thank you.Weight loss 2015: -4lbs January (thanks flu):wall:

I have just started DMP with CCCS making my first payment today but i have a concern regarding bank account, one of my debts is a joint overdraft with my ex for £1560 i have another account with them that i have my wages paid into and pay my bills. I have been looking for a basic bank account have tried Citibank sent paperwork back they just needed a bank statement which i enclosed. Tried Co-op and was going to try some of the high street banks but i dont have a valid passport its about 2 years out of date and i have only just managed to get my driving licence back of my ex and sent off for address change.
I have spoken to staff in my local HSBC branch and they said that HSBC MIGHT take money from my current account to pay of overdraft, they havent up till now i have been paying £10 a month for 2 years, according to my DMP i will be paying them £34. I am just worried that now i am on DMP they might go into my current account and take money, before i can get another sorted out. I handed my DMP form in at my local branch and they told me to pop back in, so i am going in this afternoon. Any advice please
Hi there.
Although HSBC haven't taken anything from your current account, there is no guarantee so it's definitely important you get one elsewhere. If it's taking a while to get another account open, could you possibly arrange to get your income paid into a family member's account? Are you having trouble opening another account, or is it a case of waiting a couple of weeks for the new one to be set up?

Hi
My husband and I have a self dmp devised by the CCCS. We changed our bank account as suggested to A&L however they are now Santander. My sole car finance is with Santander and they have caused me the most problems... phoning and sending around to my house abusive people from Credit Style Limited. Unlike the other creditors they have made me very depressed. We need a new bank account urgently but can't think who is left and more importantly who is safe from the credit crunch now all banks seem to be owned by the same companies! We have debts with Santander Finance, HSBC, MBNA, Northern Rock (unsecure part of mortgage) and Sky card.
Many thanks.

Jules ... I know this is a thread for the CCCS reps, but just as a quickie, have you tried the Co-op? You can apply for a basic bank account online. Or I believe Barclays are ok with opening a basic bank account for those of us with DMPs, if you prefer?

I am not sure if either of these are associated with MBNA... who seem to be associated with everyone!JULES

I have been reading on the forum about challenging the enforceability of debt by requesting a CCA. What happens if the CCA is not produced? Some people have said that you can then stop paying the debt, but presumably this would continue to show on your credit report as not being paid? And if so, what is the course of action - to wait 6 years without contact and then apply the limitations ruling? Confused!
A CCA request is to dispute that you owe the debt i.e. if someone has taken the debt out in your name or the creditor is completely chasing the wrong person, not a way of avoiding paying if you owe the money.
Again the limitations act is not there to avoid paying back debt, this is for old debts where no contact or payments have been made within a six year period.
Do you owe the debt? If so, then if you are unable to make the full payments you could always look at paying a smaller amount to get the debt cleared.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. Matthew, Sarah, Alan and Sue,
Hi guys,
I have recently set up a DMP with Payplan and make my first payment tomorrow morning by standing order. Two of the debts in my DMP are my a Lloyds overdraft of £2500 and a Natwest one of £2000. Both balances stand slightly in excess of their overdraft limits. Lloyds at -£2543.00 and Natwest -£2027.35 with charges and interest to be added over the next few days.
Once the DMP gets up and running (if they agree) they will both be receiving around £40 per month. However becuase they are over the overdraft limit now they will be picking up monthly fees and daily charges in Lloyds case. These charges and interest will amount to more a month than the £40 payment. As a result I don't see how it is ever posisble for the balance to ever come back within the permitted overdraft limit so I can start chipping away at the deficit.
Am I missing something as I am now really worried about it all again.
Thanks in advance, Jonathan.
Hi Jonathan,
Payplan will ask your creditors to stop the interest and charges for you. Even if initially the creditors don’t agree, let the dust settle and hopefully they will then. You could always look at reclaiming you bank charges then by following Martins guide on this forum.
Have you already opened a basic bank account where you have no debts? If not do this as soon as possible.
Hope your dmp goes well with Payplan and let me know if you have any questions.
