Hi
We'd really welcome your comments on our situation as posted elsewhere on the forum. I've cut and pasted our SOA below and would be very grateful if you could help. We have an appointment with an IP in a couple of weeks time so have some time to change our minds about going down that route.
"brief history, myself and wife have sank into financial dificulty, no excuses, simply spending more than we earn. We've tried to borrow ourselves out of it but just gone further under, we're at the point that although we both have good jobs and earn well we simply don't earn enough to cover all our debts. We've sold the toys to cover monthly payments. Recently been to CAB who advise IVA and have an appointment with them. However reading this site it seems that we may have an alternative with CCCS. I've filled out their forms and reckon with CCCS and huge efforts to reduce our monthly expenditure we would possibly be able to avoid IVA. I'd really appreciate any thoughts, (already accept that the Sky will have to go, we get broadband phone & telephone package) We moved house just before the down turn in house prices (not in negative equity yet, but not really concerned as we don't plan to move for decades)"

Hello,
I've been on a DMP with CCCS for almost 5 years (was with Gregory Pennington for few months before that!) The last payment was today (1st November) which was almost £160 less than the usual direct debit of £527.
When I checked my bank statement online the direct debit has gone out for the full amount of £527!
Could this be because it's a Saturday & the direct debit amount is 'provisional' according to my bank statement?
Or is it an error by CCCS?
I was budgeting on the lesser amount being taken & so now will be really struggling next week. I can't contact CCCS until Monday so it's a bit worrying until I can actually talk to someone there to get it sorted.
Then I saw this thread on here & hope you might be able to put my mind at ease.0 -
hello CCCS
I am brand new to this so if I'm doing it wrong - sorry!
I have a DMP through CCCS ( just into its second year- I owe £14,500- living a lifestyle I couldn't afford followed by health necessitated job change and income cut of £10, 000, followed by a child going off to university)and have just sent my review details in - am able to double my payments to £121 pcm as I have changed jobs and earn more. I am waiting to hear about the review but... I am expecting to come into about £5000 that I was planning to send to CCCS but now I have been trawling this thread I recall seeing someone advising another individual NOt to make one off payments to a DMP and instead to save it with a view to making a full and final payment offer.
What would you advise?
Thanks0 -
Hello CCCS
I have my appointment next week to speak to someone about my situation. I have recently returned to full time study but I'm getting funding from the university which I will use to pay my debt. I have tried to reduce my outgoings as much as possible and gained additional help from my husband i.e. he will be paying all household bills including the rent so that my studentship from the university can go fully towards my debt. My husband is also suffering financially but seems to 'cope' better than I do but this does mean that he has to work all hours that god sends just to keep our heads above water. My question is - will the creditors need to know about his financial situation [will they assume he has enough money to get me out of debt?] as I do not want to drag him into this. Not that he is in the position to help me any more than paying all joint bills.
Thank you.0 -
Another very worried person here.
I have a Halifax credit card debt of 15k. Have been paying regular payments to a debt agency and increasing the amount as and when I can afford it. It's now a £100 per month.
I have just received a statement from the Halifax asking for the full payment of 15k.
What are the steps I need to take?
Any advice would be appreciated - I have no CCJ's and this is the only debt I have.
Many thanks0 -

I have just started DMP with CCCS making my first payment today but i have a concern regarding bank account, one of my debts is a joint overdraft with my ex for £1560 i have another account with them that i have my wages paid into and pay my bills. I have been looking for a basic bank account have tried Citibank sent paperwork back they just needed a bank statement which i enclosed. Tried Co-op and was going to try some of the high street banks but i dont have a valid passport its about 2 years out of date and i have only just managed to get my driving licence back of my ex and sent off for address change.
I have spoken to staff in my local HSBC branch and they said that HSBC MIGHT take money from my current account to pay of overdraft, they havent up till now i have been paying £10 a month for 2 years, according to my DMP i will be paying them £34. I am just worried that now i am on DMP they might go into my current account and take money, before i can get another sorted out. I handed my DMP form in at my local branch and they told me to pop back in, so i am going in this afternoon. Any advice please0 -

Plus With An Iva Would Thy Make Me Sell My Car If It Is On Hire Purchase Even Tho I Need It For Work As A Community Nurse?
Plus Can A Deby Collection Agency Force Me To Pay Via Court Or Take My House?
Thanks V Much.
Hi there.
In answer to your questions:
1) A default notice would stay on your credit file for 6 years once it's been issued.
2) If an IVA was a suitable option for you, you maybe able to keep the car on HP providing the creditors agree to it.
3) A collection agency can only force you to pay by court if they've obtained a CCJ against you. The only time your home would be at risk is if the creditor obtained a CCJ against you, then applied through court obtain a charging order and then request an Order of Sale. This is something that only happens in extreme cases, and I'm yet to personally come across a client where this has happened.
Hope this helps.

Normally, interest will be stopped once a debt is passed onto a debt collection agency. If you have enough money set aside to look at making full and final settlement offers you often save a lot of money. For most people this isn't really an option due to the fact that they haven't a lump sum of money they can use to do so.
