Ask a CCCS counsellor a question

Hi,
Please can you help me with this, I forgot to ask when I was on the phone with the CCCS this morning discussing my impending bancrupcy.
I have two savings accounts set up for my children, I use it when they are given money as gifts from family and friends. They each have aroung £350. Will they lose this when I go bancrupt? The money is not mine, but the accounts are set up in my name for them as they are only 3.
I would hate for them to go without due to my stupidity. Please let me know whether or not the money is safe. If not, am I entitled to withdraw it and keep it until I can set up more accounts for them?
Many thanks, Sam
Hi Sam and thank you for your message
The official receiver (OR)would certainly look at all bank accounts in your name so you would have to declare it and the OR could include it in the bankruptcy.
You would not be able to withdraw the cash, as the OR would question where the money has gone.
You could try and explain the situation to the OR but it is doubtful you would be allowed to keep the money, even though it is solely for the purpose of the children.

I would advise against doing this, as the OR would know there was money there it may lead to a Bankruptcy Restriction Order (BRO). I would recommend to been up front and honest with the OR then it would be a complete fresh start.

My partner who I live with now knows nothing of the debt and would kill me if he knew. The debt is a barclay card loan and is for Approx 7 grand. However on the letter it says nearly over eight and a half thousand. I have no income only child benefit and tax credit he pays for everything else. I defaulted in 2006 and nothing happened now I am being hassled by this company. What Can I do. I lost my job and we have three very young children. I have been diagnosed with depression and its getting worse with this and I see my Pscyh regularly and cpn. Please help its driving me to despair and to the brink.
Hi Snowball,
Use this letter to send to the creditors to stop the calls; you may also want to ask them for a breakdown of the balance so you can query the difference.
To whom it may concern
Dear Sir/Madam
I am writing to ask that you no longer contact me by telephone as your calls are causing me considerable stress due to the frequency, and that they are being made at inappropriate times. Please remove my telephone number from your database and send all future communication in writing to my home address.
I have provided the most recent copy of my income and expenditure to make you aware of my current financial situation. I will continue to make my payment of x on the x of every month and will keep you informed of any changes in my circumstances as I am keen to resolve this issue as soon as possible.
I understand that following this request if you continue to call I can contact the Office of Fair Trading to make a formal complaint.
Please confirm in writing that your records have been amended.
Yours sincerely
You would be able to offer reduced payments to clear the debt, however if you are on a low income this may take you a long period of time.
I would recommend that you have an appointment so we can help you put a budget together and look at your long term solutions. You could either have a telephone appointment If you would like to talk to a debt counsellor about your situation, to book an appointment please call our helpline free on 0800 138 1111. Lines are open Monday to Friday 08:00-20:00. It would be helpful that when you call you have details ready regarding your income, expenditure and creditors, as this can help speed up the referral process. If you have this information ready it may be possible to refer you directly to a counsellor if one is available, otherwise we will arrange a time that is convenient for you to be called back for an appointment. Or you could visit our online debt advice facility called Debt Remedy. Debt Remedy would assist you in completing a financial statement and you would be provided with tailored advice on the best way to deal with your situation. Click here to go directly to Debt Remedy.
Hope this helps

Hi - we have filled out an online debt questionnaire and it suggested a DMP which we are in the process of collecting all the paperwork for etc and it is due to start month 07, July. Really not looking forward to it in the slightest and actually quite scared and feeling very sick when I think of it
The thing is that when I filled the questionnaire out I put in some of the details incorrectly as I had been hoping to have a higher paid job which I didn't get sadly and when I now enter the correct figures in it has suggested a monthly payment of £380 compared to the £540 it stated first of all and what our DMP is currently being set up as - can I change the current one with this new monthly payment of £380?
We have debts of just short of £33k over loans, credit cards and store cards.
Regards Claire
Hi Claire,
We have answered this for you via PM's from your other post

I've seen people mention on here about making offers to debtors to settle debts... how does this work? I have a debt with Virgin Credit Card at over £11,000 with 29.9% APR... are people saying that it is possible to make Virgin an offer for a proportion of the debt and to just walk away from it?
This would certainly be a better option for me than an IVA - especially if Halifax (who I owe approx £6300 to) would do the same.
Thanks for any advice,
Bob
Hi Bob and thank you for your message
If you are making regular monthly minimum payments and are not in arrears, then it is unlikely the creditors will accept a “full and final” settlement offer.
If you have been making reduced payments for a while and there is no hope of increasing your offer of payment in the future, and the debt would run for an unrealistic term, then you could look at offering “full and final” settlements. But the creditors do not have to accept. It is at their discretion.
I will PM you with more details on full and final settlements.
Regards

Hiya not sure if this is right place to ask this, but i am not sure what the best thing to do is. I have £9500 on lloyds duo cards outstanding, £75000 mortgage and further £6500 loan with myn bank A&L. At the begining of havin credit card i missed a few payments by a month and think its effected my credit rating as my bank will not lend anymore and Looyds are refusing also the interest is alot on credit card so i was thinking bout the balance tranfers. Im guessing it wont be easy as to bad credit? Anything else that i can do?
Thankyou for any ideas...0 -
Hi there,
i have been in contact with CCCS, one things i am unsure about is the person i spoke to said that my BrightHouse account is a priority debt and needs to be paid.
Is this correct and if so why? As i am struggling to find the money to even pay half of it, so i am slightly worried.
Thanks0 -

Hello,
Bright House agreements are not standard debts they are set up as hire purchase agreements. If you were to default on a HP agreement this would put the item at risk.
What was the outcome of your appointment?

Hi,
Would they be able to gain access to my home to retrieve the items?
I have a counselling session in two weeks time, so i am unsure what to do about BrightHouse in the meantime.0
