Ask a CCCS counsellor a question

I would like to ask the experts a question. My OH has debt totalling £39k which he told me about in February, he didnt know the full extent of how much he owed until I sat down and went through every piece of financial stuff he had.
He has finally come to terms with the fact he NOW has to start dealing with it as we want to move in together which we are doing on 01July.
He will be making a telephone appointment with CCCS in next few days to discuss his options as he has been drawing cash for years on credit cards to meet minimum payments which he can now no longer do since nobody will extend his credit limit (quite rightly i think) and he has no assets so im surprised how he has been able to reach that amount of debt to start with.
Anyway im rambling so to get to the point, ive roughly worked out his outgoings and he will only have around £300 spare to pay the creditors each month and the total of his minimum payments is around £990ish so once we move in he will not be able to make the minimum payments any longer.
Im going to draft the letter stating his situation and offering a payment to all 5 creditors but hes worried that he wil get bombarded by letters and phone calls refusing his offer of payment, what do we do if that happens?
Given the current climate roughly how long can we expect it to be before he can speak to a counsellor as we
need to get things in place ie letters to creditors explaining the situation and offering a token gesture of payment and as its myself that will be doing all this work (my partner is still burying his head and reluctant to deal with it)
I need to start getting letters typed up, im currently spending all my time on this when im not working and its becoming emotionally draining.
Also, if we do the budget planner and try the DMP would they want to take my salary into consideration as well? Does he declare he is living with his girlfriend or that hes just renting a room off me since everything at our new rented house will be in my name. I am worried i`ll be expected to use my salary to help him and I just cant afford to do that. To be honest Im expecting that his options will be either IVA or bancruptcy since it will take him at least 10years to pay the debt and thats assuming they will freeze the interest. I am 42 and he is 37 and we will not be able to try and live this way for the next 10 years, we want children and cant even afford to get married so doing a DMP would prevent us from having the option of doing this.
I just feel that we would have no life doing DMP and it would be like a noose around our necks!
Many thanks
Hi there.
If once we have the necessary information we can often transfer you to speak to a counsellor straight away if one is available. Alternatively, we will arrange to call you back at the earliest convienience.
When discussing the figures to be included within the budget it can be done in one of two ways. Either we look at including all of the household income and all of the household expenditure, or we can look at just your husband's income and only his share of the expenditure. If you would like to keep your income seperate, then I would suggest the latter would be better for your husband.
Hope this helps,

Hi,
I contacted CCCS due to my Debt prob. But when the judge asked me, I was telling that I am seeking advice from CCCS and given the Budget also.
But I still was given ccj and had charge on the property. Now the debt collectors are charging me £0.50 intereste on top of it which is costing me £17.50 a month. Therefore I cant even make small monthly payment as CCCS adviced me.
How can I resolve this ? Who do I approach ? I wanted the freeze the interest ....

Hi there.
The fact that you have contacted us doesn't stop creditors from still applying for a CCJ. Likewise it cannot stop you from paying interest on your debts.
How much did we advise you to offer in the first place? Secondly, how must did you offer when you were given the CCJ papers? If you are struggling to pay the £17.50 you can reapply through the court for a redetermination of the payment.
Get back in touch if this is something you are wanting to do.

I joined my dmp back in 2006. I owed barclaycard masterloan £4,000 I have sinced paid back over £3,500 and now owe them £470 or so I thought.
Back in October I received a letter telling me to change my account number and sort code for my payments which I did..... have since found out this was meant to be a reference only and was not an account number or a sort code!
Payments have now started to be returned to myself as they could not link the payments. This has been happening for 6 months nobody telling me there was a problem.
Barclaycard had me in the collections department and I was being charged 21.74% apr on what was already a 23.9% loan with front loaded apr.
They are now saying I owe £2.750.00 or there abouts, When I ring cccs Im told they can't help me and that I need to ring Barclaycard and when I ring Barclaycard im told to ring CCCS.
This has majorly set back my debt free date it seems like it will never end with all these apr and charges.

I have a querey on an old debt that I need help with - I've tried calling CAB and another place for advice but can never get through - hope you can help.
I've received 3 letters (In my maiden name) for debts over 8yrs old. One of these I have no knowledge of.
Stupidly I agreed a repayment plan for one of the other debts which I thought I did owe before I learned of statue barred and before I spoke to my husband who is convinced the debt had been paid anyway. What can I do?
I've since had letters from them again saying I have made no contact to arrange repayment even though with one I did? With one of the others I asked for proof of the debt as I have no idea what it is.
Will a statue barred letter work for all 3 of these debts or just the 2 I have made no payment on? Does a telephone call count as aknowledging the debt?
Also where do I stand with these being in my maiden name?
Many thanks in advanceDebts today (11/05/09) £15700 ish aiming to be debt free by April 2011

Hi,
I am in the process of putting all my paperwork together in order to start my DMP on 1st June. I am worried about this, but it has to be done, as my main creditor is Barclays (2xloan, OD and Barclaycard). I just wanted to know if anyone has had experience with Barclays so I can prepare myself.
Also, I am trying to open my step account with Natwest but they seem very busy at the minute and I am concerned that this wont be completed in time for my salary to be put in the new account.
Is it reasonable to send my DMP letters to Barclays towards the end of the month as my next payments aren't due until the 01/06.

Hi,
After my CCCS interview yesterday I am starting things off today and need to open a new bank account. I was going to use Halifax but noticed they are linked to Lloyds - who I have debts with.
Looks like I'm left with Nat West, Co-op or HSBC - can anyone tell me if these are linked to any credit cards (apart from their own) as I have quite a list of creditors.
I have searched the forum but can't find this information.
Thanks
Edit: Managed to find some links:

Hi,
I owe on two accounts from the HSBC (£1,200 from a credit card and £1,600 from an overdraft) and they are now in the hands of a debt collection firm.
I sent a CCA request for the credit card account over 3 weeks ago and not had anything in return. Whats my next step?

HI, Sorry if this is wrong but this is my first time asking a question. We are in debt to the value of around £90,000 and are working with DebtDR to help find a solution. We are in the process of setting up a DMP and have been advised that the best solution would be to sell our house, which has around £130000 equity, in order to pay off the debts, with the intention of trying to get the creditors to agree to a final settlement. This would mean going into rented accommodation and starting all over again with no chance of getting a mortgage because of our bad credit. I just wanted to know how long a DMP runs for and if there is any other way we can deal with this to save selling the house.
Thanks Liz0 -
Hi MSE colleagues
Hope this is posted in the right place or tell me where too post it ( tried the bin but thats full !)
I owe about 6.5k a shortfall payment from the last recession. I have been paying it regularly and tried in vain for a settlement figure or a write off without any success. This debt is over 10 yrs old and had the interest charges stopped by county court 8 yrs ago.
Now retraining and I only have a small NHS bursary to survive on for the next 3 yrs. I own my car but have no other assets.
I cannot even afford a token payment and the company are prepared to wait it out.
How can I get them off my back? I trying to play ball but they wont budge.
any ideas please??? This is not my only debt just a stubborn one.
really apprec

Hi Matthew,
Thanks for replying. We called CCCS to try and make a telephone appointment to chat about this and confirm that Bankruptcy is a more suitable option for my boyfriend than IVA.
The lady said she could only take the budget into account for his circumstances now not when he moves in. He will have to move in with me as he is unable to live at his family home due to his debt problem.
He cannot make the minimum payments on his debt once he does this and so we are urgently need to decide what he has to do before he moves in as he will have to default on the payments.
I do not want my salary to be taken into consideration as we are not married and we have no links together and I cannot afford to pay for his debt when im am only just getting by on my own salary.
It is unlikely IVA will get approved since one of the creditors has the majority of the debt which is 24k the other 15 is spread of 4 credit cards.
He is finding it hard to accept that Bankruptcy is the most suitable option and just wants some expert advice and clarification on it as the whole process of actually getting to speak to someone is frustrating and is getting him down to the point that he thinks the only way out of this situation is if he wasnt here at all.
Its putting such a strain on the relationship and is totally ruining any chance of a life for us together.
