louise56489 wrote: »If you make an offer of payment on an outstanding debt, no matter how small, is this acceptable and does the company have to accept it?
Hi louise56489 and thank you for your message
It is important when offering a reduced payment,to send each creditor a copy of your income and expenditure so that they can see your full financial circumstances.
However, the creditors still do not have to accept your offer.
If they refuse, then send the payment anyway and make sure you send it regularly.
Never try to pay more than you can realistically afford,as you could fall behind on your priority payments, which would make your situation worse.

Hi scruffypet and thank you for your message
Send them a copy of your income and expenditure and full list of any other creditors, if you have not already done so.
Any surplus you have left after paying all your priority needs is the amount you have to offer your creditors. This should be worked out on a pro rata basis so that they all get a fair share.
If there is nothing left, then just offer a £1 token payment until your circumstances improve.
If you have already done all this and they are still asking for more, do not be pressured into paying more than you can afford.
Just continue to make the payments you can afford every month.
You can ask the creditors to consider stopping the interest and charges, but it is entirely at their discretion whether they agree to do so.
If you would like to speak to a debt counsellor about your situation, you can ring for an appointment on 0800 138 1111.
The counsellor will look at all options available for your situation and help you to prepare a realistic budget to send to your creditors.
Hope this helps

Helloo
I'm getting my things together to do a DMP.
One question (for now haha)
I have a account (HSBC) I barely use.. it has a small amount left on a loan about £400.. and a credit card with them that has about £500 on it. I would really like to keep that account to use as my main account. (nothing really in it at the moment tho) ...
Would I be allowed to keep those two things.. and carry on steadily paying them off?.. or do I HAVE to include them in the DMP?
ThankyouVery proud of trying to deal with my debts. LBM 04/09

Hi Eupho,
They would need to be included in your dmp, if not this would be treating HSBC preferential over your other creditors.
As you have debts with HSBC you would also need to open a new account at a bank where you have no debts.

Hi,
I would like to ask the experts a question. My OH has debt totalling £39k which he told me about in February, he didnt know the full extent of how much he owed until I sat down and went through every piece of financial stuff he had.
He has finally come to terms with the fact he NOW has to start dealing with it as we want to move in together which we are doing on 01July.
He will be making a telephone appointment with CCCS in next few days to discuss his options as he has been drawing cash for years on credit cards to meet minimum payments which he can now no longer do since nobody will extend his credit limit (quite rightly i think) and he has no assets so im surprised how he has been able to reach that amount of debt to start with.
Anyway im rambling so to get to the point, ive roughly worked out his outgoings and he will only have around £300 spare to pay the creditors each month and the total of his minimum payments is around £990ish so once we move in he will not be able to make the minimum payments any longer.
Im going to draft the letter stating his situation and offering a payment to all 5 creditors but hes worried that he wil get bombarded by letters and phone calls refusing his offer of payment, what do we do if that happens?
Given the current climate roughly how long can we expect it to be before he can speak to a counsellor as we
need to get things in place ie letters to creditors explaining the situation and offering a token gesture of payment and as its myself that will be doing all this work (my partner is still burying his head and reluctant to deal with it)
I need to start getting letters typed up, im currently spending all my time on this when im not working and its becoming emotionally draining.
Also, if we do the budget planner and try the DMP would they want to take my salary into consideration as well? Does he declare he is living with his girlfriend or that hes just renting a room off me since everything at our new rented house will be in my name. I am worried i`ll be expected to use my salary to help him and I just cant afford to do that. To be honest Im expecting that his options will be either IVA or bancruptcy since it will take him at least 10years to pay the debt and thats assuming they will freeze the interest. I am 42 and he is 37 and we will not be able to try and live this way for the next 10 years, we want children and cant even afford to get married so doing a DMP would prevent us from having the option of doing this.
I just feel that we would have no life doing DMP and it would be like a noose around our necks!
Many thanks

Hi,
I contacted CCCS due to my Debt prob. But when the judge asked me, I was telling that I am seeking advice from CCCS and given the Budget also.
But I still was given ccj and had charge on the property. Now the debt collectors are charging me £0.50 intereste on top of it which is costing me £17.50 a month. Therefore I cant even make small monthly payment as CCCS adviced me.
How can I resolve this ? Who do I approach ? I wanted the freeze the interest ....

I need help from a CCCS member of staff.
I joined my dmp back in 2006. I owed barclaycard masterloan £4,000 I have sinced paid back over £3,500 and now owe them £470 or so I thought.
Back in October I received a letter telling me to change my account number and sort code for my payments which I did..... have since found out this was meant to be a reference only and was not an account number or a sort code!
Payments have now started to be returned to myself as they could not link the payments. This has been happening for 6 months nobody telling me there was a problem.
Barclaycard had me in the collections department and I was being charged 21.74% apr on what was already a 23.9% loan with front loaded apr.
They are now saying I owe £2.750.00 or there abouts, When I ring cccs Im told they can't help me and that I need to ring Barclaycard and when I ring Barclaycard im told to ring CCCS.
This has majorly set back my debt free date it seems like it will never end with all these apr and charges.Official DFW Nerd number 227

Hi
i was recently contacted by Booker Management Services acting on behalf of Barclays Bank plc.
They refer to a loan from 2002, the last payment was in December 2003, and there has been no contact since.
In february 2009 i replied to BMS to request full details of the account. the have sent some statements and the deed of assignement and a basic loan details overview, but no signed copy of the contract.
they also failed to provide the details within 40 days, though i am unable to prove that.
am i able to challenge this debt?0
