Hi there Alec.
Normally you will be given 21 days from the order to repay the amount before them issuing a Warrant of Execution whereby the remaining balance will be passed to a bailiff to recover.
My advice would be to get in contact with the Council ASAP and try and come to some sort of payment arrangement. Although you might not be able to pay the fines off within the 21 days, some Councils will often allow you to spread the cost over so many months. If not, then they are entitled to pass the debt to the bailiffs where you will be able to make an arrangement to clear the balance. Just ensure you don't let them in as it's likely they will start to levy goods to clear the balance by taking posesssions.

Mobile contract are something that the courts will deal with on a case by case basis. It is up to the Official Receiver, but as long as the amount you pay isn't really high and pay as you go wouldn't be a lot cheaper they will normally allow you to continue.
Your utility bills can stay in your name, though the courts will notify them that you have gone bankrupt. It has been known for utility companies to want to install prepayment meters following bankruptcy but not in every case. It would be down to the companies discretion how they would deal with it.

I have two mobile contracts (both identical) one is mine and the other is my sons (he is under 18 so it had to be in my name) will this affect their decision whether i can keep the contracts or not?
Also, what about car insurance? will i still be able to obtain car insurance on monthly payments? and will my existing policy be cancelled??
I started off feeling relieved that this would soo be over but now i'm beginning to panic about the things (like monthly insurance payments) i have taken for granted for so long!0 -

Just wondering if a counsellor could help. A few months ago we were really short of money and stupidly got a payday loan. Last month we couldnt afford to pay it back and were a bit short again so paid the loan then got another slighly higher one out. Now we just cant even afford to pay the interest, could this loan be added to our dmp? Or will we just have to find some way of paying it?'They only had one cow!'0 -
one more question
one of my debts is with Next Directory (catalugue) can I include this on the DMP? I wasnt sure as I used it to buy a cooker before christmas (old cooker packed up & it was the only way I could afford one) if I include them in the DMP, would they come & take the cooker back? as i couldt afford to buy another one!

Hi there.
Whether you can keep both contract phones would be up to the Official Reciever to decide, and you would be able to discuss this with them on your post bankruptcy interview.
As far car insurance, there should be no need for your policy to be cancelled unless the provider has made clear that being bankrupt invalidates the agreement. Most future providers should allow you to pay on a monthly basis.

Hi there,
Technically taking out a Payday loan has broken the conditions of the DMP as it would be classed as taking on further credit. However in some cases extra detbs can be added onto a DMP if it can be justified. Your next step is to give us a call so we can discuss it in more detail and see if we can get something sorted out, as you don't want to carrying on the way you are as you will be stuck in a vicious circle.

Hi there,
Yes you would definitely need to include the Next debt in the DMP. Products taken out of such a catalouge are subject to standard credit agreements, and therefore the finance is not directly attached to the item. With that in mind, Next will not take your cooker if you stop paying the agreed payments.

Hmm.... By the time i get to the post bankruptcy interview it will be too late to stop them cancelling my contracts wont it?? any suggestions as to how i could work around this? I'm not planning on telling my son anything about the bankruptcy but he would notice something going on if his phone was suddenly cut off!
It may sound trivial that i'm worried about mobile phones but i'm disabled and need to be able to contact someone if i fall or breakdown in the car etc. My son needs a phone so i can contact him. i dont pay for his contract, he pays it himself out of his weekend job wages- could this fact make a difference to one of the contracts? do i even have to mention this 2nd contract with me not paying for it?0
