    Hi,
    My story so far.....

After o/h redundancy 4 years ago I have entered into a payplan scheme paying £1 per month to creditors approx £25-30K This has been a secret I have lived with all his time along with another personal loan from HSBC taken out before the payplan thing but afraid to inclde as we have a joint account with them and o/h pays salary into it, and hsbc will automatically take the £457 monthly payment from it..... I am now on incappacity benefit and as o/h has taken a lower salary and we have a huge mortgage taken after a move to make money ona property (which we have but cannot now sell it) taken out before o/h redundancy....

I do all the money dealing and we have survived these past years on reclaims with advice fom Martin Lewis, but now things have gotten awful and we cannot meet our monthly bills I have not paid the council tax for 4 months mortgage has fallen by £2000, endowment policy behind by 9 months and we have no surplus cash, I am struggleing to sleep and o/h is not aware..........

    could go on..........

Oh dear.....no hugs from me but at least you have admitted what you've done. The hard thing now is to let your OH know before it gets worse. My now ex-husband did this to me and the trust within our relationship flew out the door and our marriage broke down, but probably because he didn't tell me what he was doing - I found out the hard way. He then left me to cope on my own and now I find myself in an intolerable situation in having to beg my creditors for lenience but it's not working to date.
:j Got the loan and now down from £9k to £4.5k. Trying to get a better mortgage deal now but thanks to ex-husband I am being knocked back..... Still in a better place than two years ago. Have faith!:j

Thank you for your support and reply, we have been marries for 25 years and my o/h is very supportive, its my guilt that is stoppin me from telling him, I have always managed tings and he has been happy to pass the responsibility on to me, I feel I have let him down and just need to see the light.
  • Hello there, again I'm not sure if you can help me out with some advice.

Its with LTSB Bank. After several letters between me and them, (have been trying to claim back my bank charges and stop any more charges onto my account) they have sent me a letter telling me to get into contact regarding my financial situation. I have previously sent a financial statement (heard nothing about that either) So I did and they have said they cannot do anything with me, it has to come from the Consumer Credit Counsiling Service. The CCCS has to put in a proposal for me to the Financial Management Unit. But whenever I call it cuts me off, that line is always unavailable. So I hope you may be able to help.

Ok I have an overdraft (an old student account) of £500 and the only money I have coming in are benefits of Child Benefit and Tax Credit from my partner working, totalling roughly £120.00 per month. I gave up work to become a full time Mum. I have nothing else coming in. With this money I balance the monthly outgoings, school run (bus fares), my bills, catalogues, my personal bits n bobs. So every month it is all allocated very precisley. Last month I went over my overdraft by £2.00 and by the end of the month they charged me nearly £80.00 in fees. Taking me £581.88 overdrawn! I did write to them before the fees were applied, requesting they didn't take the proposed charges, but this was ignored. So now when I get any money this month (end) it will be swallowed up by the fees. I'll have £10.00 if I'm lucky to balance my bills. This is not enough. I also have a credit card with LTSB that has reached it's maximum and has gone over it's limit in charges and interest.

Now get this,LTSB actually advised me over the phone, not to make any more payments and to get myself a CCJ to prove my F.hardship. I missed one payment, felt uneasy with that and contacted them to try and arrange a payment scheme. ( I don't want to NOT pay my bill, I just wanted a bit of a breathing space) So they closed my account and I pay £11.00 a month to them. And they add £8.10 in interest a month. So effectively I pay £3.00 a month off on my balance. My balance for that account is £1800+. I am in dire straits and don't know what to do in my situation. My letters keep falling on deaf ears at LTSB.

Can anyone help or advise me please.

    Thanks

Miller, Hi just read your story....I'm sorry

Guilt is a heavy burden...I feel it everyday, I got myself in a bit of debt years ago, gave up work, no money, child and home to create etc and my O.H bailed me out. I am now in not as much debt again...but he can't do it again. We struggle every month.

But the hardest thing was to tell him the real deal....That was hard and embarassing and I really have no idea what he really thought...he's a very good and kind man.
But you have to find the strength to share it....write it down, it's very scary and it will hit home several times for you before you take it to him. I am sure he's aware of things (we all are)

Good Luck and take a deep breathe....your not alone ok

  • Can I just ask something? I have just compiled the First Right of Appropriation letter to my bank requesting that they don't touch my money that's going to come into my account. I found the template on the previous page of this thread...am I able to do this aswell? It was advice for someone else on here though.
    Thanks

    question!

how does calculating everything via the calendar way help us out since income that we dont actually get till ten months time is being used now. i cant get my head round it so would appreciate info on how its all worked out!

    thanks in advance!
Hi debtmuncher and thank you for your message

I am not quite clear what you are asking regarding “income you do not get for 10 months being used now” ?
However, the reason Calendar monthly is used to work out amounts on budgets that are paid weekly, four weekly or fortnightly is because if worked out weekly there are 13 months in a year.
So the weekly amount is multiplied by 52 and divided by 12 to give the calendar monthly figure to change it to 12 months.

    Hi

I am looking to do a DMP - I have approx £34k of debts. I have a few questions

    a) I am a trainee accountant with the ACCA - does this affect my eligabilty to be an accountant do you know?- I have been on their website but no info about DMPs, just bankruptcy

    b) do DMP affect your ability to get a mortgage in the future (we have one but we arent in arrears with it) as when the housing slump picks up again we are hoping to move nearer my parents.

    c) does a DMP mean you cant get a credit crd in the future?

I think this is an excellent service - thank you to CCCS and MSE - i was beginning to get desperate but think this may be a way out :-)

    Thank you x

    Hi hopeful1983happy

    A) A DMP should not affect your career as an accountant, but bankruptcy could.

    B) As far as mortgages are concerned, again bankruptcy would affect you obtaining a mortgage as you would be considered a high risk.
Some mortgage brokers may consider lending the money but would normally charge very high interest rates.
But being on a DMP should not affect an application for a mortgage.
What you would have to consider is that when calculating how much they would lend you for a property, any outstanding debt is taken into account and this could reduce the amount they are willing to lend you
Also,if you had a CCJ on your credit reference file, a lot of lenders would look to see that this was satisfied before lending you any money.

    C) You would not be able to take out a credit card whilst on a DMP.
Once your debt was paid off, then you should not have any problems, however you have to remember that any defaults or CCJs do remain on your credit reference file for 6 years.

But would you want to get a credit card again once you were debt free!!!

    Hope this helps

Sorry it is me again... I have just been reading some posts above.

When doing a DMP we dont want to include our mortgage, council tax, etc it is just our personal loans and creditcards. It seems that some people have had their mortgage included in their DMPs - do you have to include it?

At the moment we are not in arrears on anything but we will start going into them this month (only on credit cards).

    Hope that all makes sense

    Hi again!

A DMP is for any non priority debts such as credit cards, loans, store cards, catalogues etc.

All priority bills such as mortgage/utility bills/council tax would be paid by you.
On the rare occasion a DMP would include a mortgage,it would be because there are arrears or problems paying and certain lenders agree for clients to include these on a DMP.
So you would continue to pay your mortgage as a priority.

Sorry if this is answered somewhere else in these pages but this sticky is so vast it'll take ages to read through it all.

If a DCA or CC company take me to court for an unpaid credit card and I am not disputing that the money is owed but just cant pay, live on benefits.
Will the judge take my income / circumstances into account when making the judgement? Is there anything in particular the defendant has to do to ensure the CCJ payments are set at an ammount that can actually be paid?

I see someone else up the board was ordered to pay in full.

    Did I get missed?
  • A friend of mine owes council tax and has been burying his head in the sand about it.
He has received a letter,(following the case being heard in a magistrate's Court, which he did not attend,) saying that unless he makes payment within 7 days they will make him bankrupt.
The letter came from the solicitor representing the council.
As he can't pay is there anything he can do to prevent this action at this late stage?
