    Agree entirely. But as the scale of this thing rules out banks or credit card companies from making "goodwill" refunds -- which have been known -- then presumably the companies concerned will want to make sure they're not going to be stung for S75 refunds without first doing everything they can to get the money out of Lapland New Forest Ltd (or whatever it's called.)

    I actually like the fact that S75 exists but intensely dislike the fact that scammers are aware of it -- they justify their actions on the basis that it's a no-pain crime (the punters get their money back so what's the problem) just like the thief who says, the punter gets it back from the insurance.

    As you say, ultimately it's all of us who pay.


    Sidebar: friends of ours in America heard about Lapland NF / Lapland WM and asked if things really were that bad, and that expensive, in the UK nowadays?

    It wasn't so much the content of the two so-called Laplands as the prices being asked, which they thought were "incredible".

    They've been to what seems to be the father-and-mother of all "Laplands" -- if not the entire theme park industry. The link makes for fascinating reading (if you haven't already heard of this; I hadn't.) And as for those admission prices, even at the current lousy dollar-sterling exchange rate. . . wowee!

    Lots of luck meggie. Your post is helpful because if Barclaycard isn't citing S75 at this stage then that's a cue for other cc companies to at least take in a claim and consider it.

    I have made a long rough outline of the case to the FSA. I just need to examine it carefully and add some links.

    It is in the form of a written submission so, even if for some reason I am not here, it will be recorded for anyone else to use, though I intend to put it to the FSA by phone. I can then quickly put it to them in written form if required to do so.

    When you read it you'll see just how damming it is.

    Well I spoke to my credit card company this morning and my Lapland New Forest £90 has been refunded. I wrote them a letter saying I wanted to do an indemnity claim as the goods were not as described and sent them in the website print outs as well as some actual photos and they called me to say they were looking into it. When I looked at my credit card online it seemed the money had gone back in so when I called them today they confirmed the "dispute had been resolved in my favour".

    Very happy indeed, especially this time of year!

    I hope everyone else has the same success with there credit card companies.
  • The good thing about that is that they have allowed you to make a claim under £100

    The bad thing is that indemnities are quite powerful legal documents to sign. They will be able to reclaim those funds back at any time, and any costs as well. Now I don't think that's too likely, but it's pretty poor that people have to sign any document to get their money back.

    Can you disclose what company it was kattwood ?

    I'm pleased for you kattwood, as I suspect all on this thread are. If it does not compromise you in any it would be useful to let others here know which CC this is, any other customers of that card could then quote the fact the CC co have already acceded, and this of course sets a precedent not only for others with that card but all CC customers. However this may make you feel uneasy and in any case our Rotweiller Gofer Gomer is on the case so for others it may more prudent to review the outcome of Gomer's investigations, so I merely leave this for your consideration.

    Gomer, please kick my virtual butt if I am out of turn in any of this!

    Sorry if I'm being slow but who is claiming indemnity against whom here? I hate to show my financial knowledge shortcomings, but if I didn't have any Lapland Norfolk would have made me a millionaire by now.
