Blue Badge Aprking

HI I am writing from scotalnd in reference to where blue badge holders can park. It clearly stated in the blue badge scheme book.
In the UK, a valid badge entitles the holder to park:-
free of charge and without any time limit at on-street parking meters and pay and display on-street parking
for as long as s/he wishes when other people may park only for a limited time, for example, on a dotted yellow line
At on-street areas reserved for valid badge holders. Local authorities may impose a time limit on parking for badge holders
In England, Wales and N. Ireland, on single or double yellow lines for up to three hours, and, in Scotland, without any time limit.

But i got a penalty notic ein Dunlop street car park yesterday. They claim everyone has to pay in that car park. They have no clear signs infact i checked the notice at the meters before we parked. they have a few small signs on the outside of the car park saying "all vechiles must pay and display. I was also told that this is the only pay and display car park in the whole of Glasgow you have to pay even if you have a blue badge.

Can they do this?

    Yes they can.

    There is nothing that entitles BB holders to free parking in every Pay and Display Carpark.

    I am in England and the majority of carparks do not give free parking to BB holders.

    Why should they?

    and how can they?. Please explain how you believe this please ? When government legislation has been breached. They have clealry discriminated against disable persons rights.

    The blue badge scheme is discretionary not compulsory. Local councils and third party parking companies can choose to allow free parking for disabled users but are under no obligation to do so. There are also a lot of inner-town/city car parks that are under the control of external companies as the councils either sold them off or the external companies bought land and built car parks.

    It is the users responsibility to ensure they are allowed to park there for free - the pay and display notices WILL clearly say if disabled badge holders can park there for free and for how long.

    I am a blue badge holder and always make sure I am within my rights to park where I am parking. For example, there is a street in my town where the majority of it is double-yellow-lined but some of it has the horizontal double lines on the curb-stones - these mean no parking under any circumstances. I was not aware of this but luckily a nice man stopped me from parking as he was booked the week before - and he had his blue badge on display.

    Another example is the roads surrounding my place of employment. They are all double-yellow-lined and you would assume you could park using a blue badge. Not true - the roads are in fact private and are patrolled on an hourly basis by Neo-Nazi clampers (under whose clutch I have been a victim of unfortunately).

    It is worth checking the following two sites: http://www.pepipoo.com/ and
    http://neilherron.blogspot.com/ either/both should tell you what you need to know. A lot depends on whether it is an actual ticket, or an invoice to park. Neil Herron (Metric Martyr) is particularly helpful - he helped me personally when I got an unlawful penalty notice despite my BB. All he suggested was that if I won, I might donate something to the Grace House Hospice Appeal - which I did gladly. Far better a charity gets the cash than some unscrupulous money-making body ;).

    Oh lord! They are not discriminating against disabled persons rights, they do not stop you from parking, but you have to pay! Where exactly is the discrimination?

    Think of it as a membership card that gets you certain benefits at certain sites/venues - where the card is accepted, it can be used, where it is not, it cannot be used. You wouldn't try and use your XYZ membership card at ABC would you?

    Whilst I said previously that you should check on those two sites, I agree with DJBenson that this isn't discrimination. They are not seeking to treat you any less favourably than they would treat a non-disabled person. Non-disabled have to pay so they are not treating you any less favourably by asking you to pay as well. it is a discretionary scheme, hence in some parts of my region there are some councils who charge for disabled parking and some who don't.

    My point is whether the ticket/invoice to park is actually legal - which can be checked out as stated.

    Oh lord yes it is . It discriminates against disabled persons rights. The government has set our leglislation and as they have breached this so they are discriminating against disabled persons rights. to not let someone use their government issued card for the reason it is meant is breaching the contract.
