    Oh lord yes it is . It discriminates against disabled persons rights. The government has set our leglislation and as they have breached this so they are discriminating against disabled persons rights. to not let someone use their government issued card for the reason it is meant is breaching the contract.

    Every now and again I come across people who will not listen to reason and are blind set on getting their own way because they have fallen foul of local laws/legislation. Here's today's example :rolleyes:

    There is no discrimination, end of story. You parked without checking if you were allowed to do so, and now you have to pick up the bill for doing so.

    Feel free to explain exactly which of your rights they have breached. As I said above (which you either didn't read or just ignored) they did not stop you from parking there, they would be more than happy to allow you to park...so long as you paid the relevant fee. It could be argued that the blue badge scheme itself breaches the rights of able bodied people by offering preferential treatment - guess you'll disagree with that too but it's the flip side of your (not very constructive) argument.

    By all means try to persue the case, but I would avoid using the discrimination angle unless you want the case filing under "J" for joker :D

    Oh, and I would make sure you are fully up on the terms of using your badge before taking up the case because in the 5 seconds I read it I spotted several points that shoot holes in your argument (full terms here)
    The national concessions allow badge holders to park on-street but they may not apply to car parks and off-street parking. In addition, other benefits may be available to badge holders - see below
    The Scheme does not apply in off-street car parks. However, some may provide spaces for people with disabilities. You should check the signs to see what concessions are available, and whether Blue Badge holders have to pay. Always display your Blue Badge when occupying one of these spaces. If you are unsure whether you can park, you should check with a traffic warden, police officer or the relevant parking attendant.

    Agree with the above posts. here is NO discrimination here! You are being treated the same as any other person. ALL drivers have to follow and agree with the rules for parking at any given car park. The rights of a blue badge holder are NOT valid in every car park or street. The rights are applicable where the council or car park owner has offered that service in their area.

    There is already a significant benefit for blue badge holders and rightly so. However, you cannot expect to park anywhere you like for free all the time - otherwise the facility will have to be downgraded!

    I would question them with this. as they are discrininationg against Disabled persons rights


    what right is this? the right to not pay for things :confused:

    I was under the impression that the blue badge entitled the disabled holder to park in a convenient spot to make access to certain places easier.

    If the area allows you to park for free then that's a bonus, however if they don't- tough luck pay up like everyone else!!

I have been told by the department for transport disability policy branch. If it is a local authority car park which it is. It must 100% show clear specific signs for all users the charges. This included Disabled users with blue badges and as this was not done it has breached alot of things.

    Rules are different in scotland. I am listening to reason . But the law superseeds reason in this case. And no i have never said it gives you the right to park anywhere at anytime i like. I have parked in the same car park numerous times with my blue badge and there has never been a problem. And as i was informed by the traffic warden it is the only car park in Glasgow to charge holders and to be checked every 15 minutes by them. As there is an extremely high turnover of blue badge holders not paying as there is no notices.

    Can I just point out that the rules you are quoting all refer to 'on-street' parking.

    That relates to parking facilities provided on the street, such as parking meters, yellow lines and so on.

    But car parks are independently run, either by the local authority or by private companies. The arrangements for disabled parking will vary from one car park to another. So charging you for parking in the car park is not a breach of any national legislation relating to blue badges.

    The best thing you can do is take the matter up with the people who own/run the car park. It is a matter of contract between you and them.

    I don't really think that the people on this board can give you the answers you are looking for.

    As someone else has said, the people on the pepipoo site specialise in helping people to overturn parking fines, so you might find more help on that site.

    I don't really think that the people on this board can give you the answers you are looking for.

    To be honest, I think the only person that can answer the original posters question is himself because he will only be happy with an answer that tells him/her that he/she is right (and clearly from the other responses - he/she is not!). I can almost certainly say he/she will not win any case on the grounds that he/she has been discriminated against. He/she may have a case on some parking technicality but I have no expertise in that area so will decline to comment.

    To the OP: The lack of signs telling you what you can do is irrelevant - my local Tesco's doesn't have signs up telling me I can/cannot take goods without paying, I just assume that I have to pay unless told otherwise. Common sense outweighs any legislation where I come from.
  • Yes they can.

    There is nothing that entitles BB holders to free parking in every Pay and Display Carpark.

    I am in England and the majority of carparks do not give free parking to BB holders.


    In the UK, a valid badge entitles the holder to park:-
    free of charge and without any time limit at on-street parking meters and pay and display on-street parking

    You keep repeating this.......and it says quite clearly ON STREET.

    A car park is OFF street. A Car park is often privately owned. Even the coucil run car parks here do NOT give free parking for BB holders.

    On Street parking often has other restrictions to it, such as time and the meters are not always at the right height for wheelchair users. By the time anyone has gone for change (disabled often being slower) the time may have run out. This is why the BB holders get it free.....and can often park on double yellow lines in certain places.

    So please.....read your booklets carefully as it does clearly state on street only.

    I do not feel discriminated against if I have to pay for parking, when I display my badge. Blue badge holders are able to use very convinant parking spaces and so this in itself is a very large benefit. I wasn't complaining in my above post I was just pointing out that some car parks do charge. I always make a point of reading available signage as to that particular parking areas rules. A Blue badge does not give you a right to park how & where you want it just provides more easily accessible availability. I don't like the idea of using the phrase discriminating against disabled peoples rights just because you have to pay 60p to park, this sort of phrase should be used for more major requirements.
