Selling a contract phone on ebay

I am thinking of getting a 12 month free line rental via cashback deal on 02 that are well advertised all over the place.
All of these phones, however, come with phones that are no better than my current Sharp GX15. Is there anything stopping me simply selling the new phone on ebay and using my current one?
I looked around the internet and some forums seemed to suggest that networks and cashback resellers monitor the IMEI number used and would know I hadn't used the phone they provided me with and withhold my cashback. Seems a bit far fetched to me but I'd like to be sure before I commit.
Does anyone have any experience of doing something like this?

The phone is yours to do with as you wish.
Obviously you would retain the SIM card for the duration of the contract.0 -
I sold mine - through my own website rather than Ebay though. I wonder what the situation would be if the person with the contract didn't pay. The sim would be disabled certainly but would the phone?0

your contract is on the sim card not the phone

Not true.
The phone is on a contract, hence the network has every right to bar or restrict.
We pay line rental which pays for the phone. In the case of redemption, the network relies on interest accumulated or they just hope you forget to send bills in.
Ok let me give an example. You sell phone to someone on eBAY
Few months later, you think, damn I dont wanna pay anymore so ill just stop..
Whos phone will get barred? The poor guy on eBAY. Also what prevents you from reporting the phone lost/stolen and then claiming on insurance ?
Sorry to sound so sceptical. I deal with phones on an everyday basis. I would never buy a phone that is tied to a contract.

the only problem occurs if you cancel the contract before the minimum term where the retailer or network can demand the phone back off you (or the cost of a new handset).0

You cannot cancel a contract. (unless there terms and conditions change which you can then breakout)

DJ - In the event of non-payment of the bill, then it would be the SIM that was barred, not the handset, wouldn't it? Or, are you saying both are barred?0

Everything I have read about this says the phone is yours to do with as you please and as stated previously is a sweetener to get you to sign up. Your monthly fee is for access to the network and whatever tariff you signed up to.0
