The wifes account is now empty and up to the buffers on the overdraft and I have opened 4 new accounts in my name. 1 for the main bills etc, 1 for shopping and one for the cars and then a cash isa if we ever have anyhting left:rolleyes:
I will get OH to open an account with the CO-OP. As it happens I'm toying with the idea of giving her a very small amount each week to help with the addiction and set her tasks as to what to do with it until we get professional help. I say this as an ex smoker if anyone nicked my fags or I had to go several hours without one it was hell on earth. You cant just cut off an addicts supply without some kind of help.
Anyway i digress, I think when the OR see's the wifes bank statements he'll fall off his chair:rotfl: but waht concerns me a little Deedee is that all of the bills have always gone through the joint account(leaving it empty at the end of the month) and no bills or DD's have gone through what was suposed to be the spending account.
Thinking about it though as i write the 'spending' account is the one OH used for the addiction and was completly hammered every month going massivley overdrawn.
Mrs L seems a bit better now, thanks for asking. She's met her mum for lunch during her diner break and told her all about it and she was great.
She also mentioned to me that she agree's that going BR will be the best thing to do:eek: so we'll talk more tonight.

Just an update
Received the letter from the OR today. It says that "Upon reviewing the information that you provided to the court I have decided that it is not necessary to interview you at this time. It is possible that for various reasons, I may decide that a formal interview is needed in the future. If this happens I will write to you"
When I went BR last Wednesday I was unemployed , however I started a new job today. On the BR forms I did make a note that I was starting a job on monday and also when I spoke to the OR's case worker on friday I told him about it too as I know I will have to do an IPA.
Is this normal as I will have to send back the standard forms I have been sent and then call them again to let them know my situation has changed, which will result in an IPA?
Also I have a car on HP which is going back as I dont need it for work, however i was looking at the small print of my car insurance policy today and noticed that they would cancel my insurance when I inform them I am BR (as it is a credit agreement, 12 monthly payments plus some interest) they would send me a final bill for the remainder of the policy. (5 months) Can this be included in the BR as I didn't mention this as a debt in the I submitted to the court.

On the insurance who is it with? I just renewed mine was not even asked about BR, never read the small print either, will do when it arrives. It is with the same company but I phoned and got it put down as they were joking on putting it up yet again this year, been with them years and no claims since 2002.
This may be a subject that needs flagging up to people as if you have a crash no good if they say SORRY you are BR did you not read the small print.
Not sure what to say to do, but try online, confused dot com, and tesco do comparison, I am paying monthly and I know others are, you can only LEGALLY borrow up to £500 under BR laws so make sure your insurance is not above that price a year.
On the forms it tells you any INCREASE in income (nothing about decrease I note!) you have 21 days to inform your OR, so you need to phone or write in to him.

With the insurance it is more the fact that I want to cancel it as I wont need it anymore when the car goes back. If I terminate it myself I am liable to pay for the rest of the remaining term as per my agreement. If I notify them that I am BR they will cancel the policy and send a demand for the remaining balance. Either way will these amounts owing be included in the BR, as I mentioned I haven't informed teh OR of these as I only just found out.
I will have to worry about getting new insurance next time I can afford a car!0 -
I would have thought as it was in place at time of BR it will fall into BR I would contact your OR and ask, if not contact debtline and ask. What a nightmare, another one that people do not consider really, things that will have an effect from BR. Hope it falls into you BR and they can go and take a swing, at the end of the day, they are not insuring you for the period of time are they.. what a take on.

Tell me about it. I dont need the car for work and it works out at £320 a month plus £70 insurance. Somebody did advise me to try and keep it as it would reduce my surplus, but I have a feeling that the OR wouldn't include it in my essentials especially as I dont need it for work, or should I chance it?0

Hi all,
Just to give you an update on my situation.
Been working now for nearly a month and must say I am so much more relaxed without having the debt hanging over me.
When I went BR I was unemployed and the OR said I didn't need an interview. I have since informed them of my employment and sent them over a copy of my payslip. I presume i will now get have an interview with the OR?
Also I informed the hp (car) company that I was BR and they are now coming to collect the car. They have sent me a default notice and a demand for the remaining balance. Do I just forward this to the OR as I declared the hp loan on the BR forms. I take it, this will be included in the BR? Is this just a technicality the hp company go through by sending me a demand.
All in all it has been a better month than the last, sure I will be after more advice when the interview is coming up.
One last thing, how long does it normally take for the OR to contact my creditors as it seems some still have not been informed. Can it take a month or longer?
